protectioN for Biodiversity<br />
In Irel<strong>and</strong>, <strong>and</strong> other countries, the activities of people have<br />
lead to a significant loss of natural habitats <strong>and</strong> species, <strong>and</strong><br />
damage to the natural environment. Legislation is required<br />
to protect our biodiversity resources for future generations.<br />
<strong>The</strong> legal framework for protect<strong>in</strong>g natural heritage<br />
<strong>and</strong> biodiversity <strong>in</strong> Irel<strong>and</strong> is complex but there are a few key<br />
pieces of national <strong>and</strong> European legislation that underp<strong>in</strong><br />
biodiversity <strong>and</strong> nature conservation legislation <strong>in</strong> Irel<strong>and</strong><br />
(for more detailed <strong>in</strong>formation see www.npws.ie). A brief<br />
summary of the objectives of this legislation follows. This<br />
summary is not meant as a legal <strong>in</strong>terpretation but as an<br />
overview of the legal framework protect<strong>in</strong>g biodiversity.<br />
<strong>Nature</strong> conservation legislation <strong>in</strong> Irel<strong>and</strong> <strong>in</strong>cludes<br />
the <strong>Wildlife</strong> Act, 1976 <strong>and</strong> <strong>The</strong> <strong>Wildlife</strong> (Amendment) Act,<br />
2000, the European Union Birds <strong>and</strong> Habitats Directives,<br />
the European Union (Natural Habitats) Regulations <strong>and</strong><br />
the European Communities (Birds <strong>and</strong> Natural Habitats)<br />
Regulations 2011. Other important pieces of national<br />
legislation <strong>in</strong>clude the Forestry Act, 1946, <strong>and</strong> the Plann<strong>in</strong>g<br />
<strong>and</strong> Development Acts 2000- 2010. <strong>The</strong>re are also other<br />
European Union directives that have implications for<br />
biodiversity <strong>in</strong>clud<strong>in</strong>g the Water Frame Work Directive <strong>and</strong><br />
the Environmental Impact Assessment Directive.<br />
<strong>The</strong> ma<strong>in</strong> objective of the <strong>Wildlife</strong> Acts, enacted<br />
under Irish legislation, is to protect all our native animals<br />
<strong>in</strong>clud<strong>in</strong>g mammals, birds (<strong>and</strong> their nests <strong>and</strong> eggs),<br />
<strong>and</strong> fish, <strong>and</strong> certa<strong>in</strong> plants listed on the Flora Protection<br />
Order. Hedgecutt<strong>in</strong>g, scrub removal <strong>and</strong> burn<strong>in</strong>g of<br />
upl<strong>and</strong> vegetation or heather is prohibited dur<strong>in</strong>g the bird<br />
nest<strong>in</strong>g season (1st March to 31st August). <strong>The</strong> <strong>Wildlife</strong><br />
(Amendment) Act, 2000 provides a statutory basis for<br />
Natural <strong>Heritage</strong> Areas, the basic national designation for<br />
sites of nature conservation <strong>in</strong>terest <strong>in</strong> Irel<strong>and</strong>.<br />
European Union Birds Directive <strong>and</strong> Habitats Directive<br />
were transposed <strong>in</strong>to Irish law under the European<br />
Union (Natural Habitats) Regulations <strong>and</strong> the European<br />
Communities (Birds <strong>and</strong> Natural Habitats) Regulations 2011.<br />
<strong>The</strong> ma<strong>in</strong> objective of Birds Directive is to protect birds of<br />
conservation concern on a European-wide basis, <strong>and</strong> their<br />
habitats. <strong>The</strong> ma<strong>in</strong> objective of the Habitats Directive is<br />
to protect species <strong>and</strong> habitats of conservation concern<br />
<strong>in</strong> Europe.<br />
