DISCIPLINARY PROCEDURE – (continued)
1.4 Should the Committee/Disciplinary Sub-Committee decide that action should be taken, one
or more of the following penalties for each breach found may be placed upon the members:
Informal stage:
1.4a Written admonishment. No appeal
1.4b Written censure (being a final warning). No appeal
1.4c Monetary fine. No appeal
Formal Stage:
1.4d Suspension (in part or in whole) from:–
• Showing or participation of the member or the member’s horses in any Association
recognised event, show or function
• Receiving or retaining an accolade/prize Appeal procedure applies
1.4e Expulsion from the Association. Appeal procedure applies
1.5 The member shall be notified in writing of the Council/Disciplinary Sub-Committee’s
findings and decision and any notice given shall be deemed to be given on the date such
notice was posted by first class recorded delivery post to the last known address of the
member.
1.6 The member on receipt of any notice (refer 1.5) will have 28 days from the date of the letter,
in which to submit a written appeal against the findings, decision or sanctions applied by
the “Disciplinary Sub-Committee” after which an “Appeals Board” will be convened. No
Solicitors letters may be entered into any appeal.
the appeal should set out the reasons for objection and highlight any area of dispute
regarding the facts of the matter.
1.7 The BSPA Appeals Board will normally consist of three Council Members, 2 of who will be
Trustees and chaired by either the Chairman of Company Secretary. The BSPA reserve the
right to bring in an external person whose expertise is considered relevant but who will not
be eligible to decide on the Appeal outcomes.
1.8 BSPA members subject to Disciplinary procedures will have the right to address the appeal
board in person and be accompanied by a support person (not a legal representative) who
is not eligible to address board members, at stage 1.7 only
