ecruit poll w<strong>at</strong>chers for Election Day. At its annual<br />
2012 conference, leadership of <strong>the</strong> group announced<br />
th<strong>at</strong> it “anticip<strong>at</strong>es training 1 million poll w<strong>at</strong>chers<br />
around <strong>the</strong> country for this year’s election.” 14 In itself<br />
<strong>the</strong> training of poll w<strong>at</strong>chers might not be worrisome,<br />
but <strong>the</strong> inflamm<strong>at</strong>ory language used to inspire this<br />
group of volunteer activists makes it so.<br />
For instance, True <strong>the</strong> Vote’s founder, C<strong>at</strong>herine<br />
Engelbrecht, has said “we see again with this<br />
administr<strong>at</strong>ion . . . it’s just stunning <strong>the</strong> assault on our<br />
elections th<strong>at</strong> we’re w<strong>at</strong>ching gain steam with every<br />
passing day, so we found ourselves to be unwittingly<br />
on <strong>the</strong> front lines of an issue th<strong>at</strong> I think will be<br />
<strong>the</strong> inflection point for this election.” 15 A reporter<br />
<strong>at</strong>tending True <strong>the</strong> Vote’s Colorado St<strong>at</strong>e Summit<br />
described how one speaker told <strong>the</strong> crowd th<strong>at</strong> “<strong>the</strong>y<br />
should enjoy bullying liberals because <strong>the</strong>y were doing<br />
God’s work. ‘Your opposition are cartoon characters.<br />
They are. They are fun to be<strong>at</strong> up. They are fun to<br />
humili<strong>at</strong>e,’ he intoned. ‘You are on <strong>the</strong> side of <strong>the</strong><br />
angels. And <strong>the</strong>se people are just frauds, charl<strong>at</strong>ans and<br />
liars.’” 16<br />
King Street P<strong>at</strong>riots has sponsored sweeping<br />
and unsubstanti<strong>at</strong>ed claims questioning <strong>the</strong> legitimacy<br />
of democr<strong>at</strong>ic particip<strong>at</strong>ion by low-income persons<br />
and communities of color. For example, in 2011, King<br />
Street P<strong>at</strong>riots hosted a $100 pl<strong>at</strong>e dinner fe<strong>at</strong>uring<br />
M<strong>at</strong><strong>the</strong>w Vadum, who has penned articles opining<br />
th<strong>at</strong> it is un-American to register <strong>the</strong> poor to vote,<br />
writing, “how else can you justify a law th<strong>at</strong> mand<strong>at</strong>es<br />
th<strong>at</strong> welfare recipients be given — be encouraged —<br />
to vote when <strong>the</strong>y’re <strong>the</strong>re in <strong>the</strong> cheese line picking<br />
up <strong>the</strong>ir check?...You shouldn’t be encouraging<br />
people to destroy <strong>the</strong> country, you shouldn’t be<br />
encouraging people to vote <strong>the</strong>mselves benefits from<br />
<strong>the</strong> government.” 17 Tom Fitton, president of Judicial<br />
W<strong>at</strong>ch, a close partner of True <strong>the</strong> Vote, said “I fear<br />
<strong>the</strong> Obama gang is setting <strong>the</strong>mselves up to steal<br />
<strong>the</strong> election” with <strong>the</strong> “illegal alien vote” 18 and also<br />
accused <strong>the</strong> president of wanting “to register <strong>the</strong> food<br />
stamp army to vote for him.” 19 In a letter sent to<br />
“Friends” this August he wrote “[a]s <strong>the</strong> scope of <strong>the</strong><br />
Left’s efforts to corrupt and steal <strong>the</strong> 2012 elections<br />
become even more clear, it is absolutely vital th<strong>at</strong><br />
lawful voters like you and thousands of o<strong>the</strong>r p<strong>at</strong>riots<br />
voter intimiD<strong>at</strong>ion<br />
& harassment is illegal<br />
To be clear, activities th<strong>at</strong> intimid<strong>at</strong>e voters are<br />
against <strong>the</strong> law. Section 11(b) of <strong>the</strong> Voting Rights<br />
Act prohibits intimid<strong>at</strong>ion, thre<strong>at</strong>s, or coercion with<br />
respect to <strong>the</strong> exercise of <strong>the</strong> right to vote, whe<strong>the</strong>r<br />
or not such intimid<strong>at</strong>ion or coercion is shown to<br />
be racially targeted. 27 Voter intimid<strong>at</strong>ion, coercion<br />
or thre<strong>at</strong>s interfering with <strong>the</strong> right to vote are also<br />
criminal offenses. 28 Sections 203 and 208 of <strong>the</strong><br />
Voting Rights Act also protect <strong>the</strong> rights of language<br />
minorities, disabled persons or o<strong>the</strong>r individuals to<br />
receive assistance <strong>at</strong> <strong>the</strong> polls if needed to exercise<br />
<strong>the</strong> right to vote. 29 Even in st<strong>at</strong>es whose challenge<br />
procedures or poll w<strong>at</strong>cher restrictions are lax and<br />
thus most vulnerable to abuse, <strong>the</strong> federal protections<br />
against intimid<strong>at</strong>ion and harassment can stand as a<br />
bulwark against abusive practices. Many st<strong>at</strong>es have<br />
<strong>the</strong>ir own legal prohibitions on voter intimid<strong>at</strong>ion or<br />
harassment. 30<br />
In <strong>the</strong> end, unfounded challenges and acts<br />
of harassment <strong>at</strong> <strong>the</strong> polls by politically motiv<strong>at</strong>ed<br />
organiz<strong>at</strong>ions thre<strong>at</strong>en to disenfranchise eligible<br />
Americans. Such activities on a wide scale can<br />
impact election results and damage <strong>the</strong> integrity of<br />
our democracy and election institutions. Election<br />
administr<strong>at</strong>ors and law enforcement officials<br />
should carefully monitor such activities and bring<br />
enforcement actions when needed to protect against<br />
abuses.<br />
Anyone experiencing or witnessing bullying<br />
of voters can call 1-866-OUR-VOTE, a hotline<br />
oper<strong>at</strong>ed by a coalition of non-profit, non-partisan<br />
organiz<strong>at</strong>ions, to report such incidents and request<br />
assistance or referrals. Complaints about such<br />
activities may also be reported to <strong>the</strong> U.S. Department<br />
of Justice by contacting <strong>the</strong> Voting Section of <strong>the</strong> Civil<br />
Rights Division <strong>at</strong> 1-800-253-3931. n<br />

fraud.” 20 With comments about <strong>the</strong> “illegal alien vote”<br />
and “<strong>the</strong> food stamp army,” King Street P<strong>at</strong>riots and<br />
