It is good th<strong>at</strong> Ohio law prohibits<br />
disrupting or interfering<br />
with <strong>the</strong> election.<br />
Ohio could be more explicit<br />
th<strong>at</strong> phones, video cameras,<br />
and o<strong>the</strong>r recording devices<br />
may not be used to record<br />
voters in <strong>the</strong> polling place.<br />
Ohio could also improve its<br />
law by only allowing electors<br />
in <strong>the</strong> precinct to serve as<br />
observers.<br />
The observer shall be permitted to be in and<br />
about <strong>the</strong> polling place or precinct during<br />
voting. Observers are permitted to w<strong>at</strong>ch<br />
every proceeding of <strong>the</strong> election judges for<br />
as long as <strong>the</strong> polls are open. Observers may<br />
move about <strong>the</strong> precinct polling place as long<br />
as <strong>the</strong>y do not disrupt or interfere with <strong>the</strong><br />
election. Observers may not take any action<br />
to intimid<strong>at</strong>e voters or put <strong>the</strong>mselves in any<br />
position th<strong>at</strong> could viol<strong>at</strong>e <strong>the</strong> secrecy of <strong>the</strong><br />
ballot or a voter’s privacy.<br />
OHIO REV. CODE § 3505.21<br />
Observers must be design<strong>at</strong>ed ei<strong>the</strong>r by<br />
a political party, a group of five or more<br />
candid<strong>at</strong>es, or a ballot issue committee.<br />
The Board of Elections must be<br />
notified of <strong>the</strong> names and addresses of<br />
appointed observers and <strong>the</strong> precincts<br />
in which <strong>the</strong>y will serve. Appointments<br />
must be made on official forms not less<br />
than eleven days before <strong>the</strong> election, and<br />
observers must present certific<strong>at</strong>es of appointment<br />
to <strong>the</strong> presiding judge of <strong>the</strong><br />
precinct <strong>the</strong> night before or on Election<br />
Day.<br />

limit<strong>at</strong>ions on <strong>the</strong> activities<br />
of w<strong>at</strong>chers or overseers.<br />
W<strong>at</strong>chers and Overseers<br />
should not be able to photograph<br />
or videotape voters,<br />
or communic<strong>at</strong>e with voters.<br />
Election judges should have<br />
authority to remove w<strong>at</strong>chers<br />
and overseers who interfere<br />
with <strong>the</strong> orderly conduct of<br />
<strong>the</strong> election<br />
Only one w<strong>at</strong>cher for each party <strong>at</strong> general,<br />
municipal or special elections, may be present<br />
in <strong>the</strong> polling place from <strong>the</strong> time <strong>the</strong><br />
election officers meet prior to <strong>the</strong> opening of<br />
<strong>the</strong> polls until <strong>the</strong> counting of votes is complete<br />
and <strong>the</strong> voting checklist is sealed.<br />
25 PA. STAT. ANN. § 2687<br />
W<strong>at</strong>chers may keep a list of voters and shall<br />
be entitled to challenge any prospective voter<br />
and to require proof of his or her qualific<strong>at</strong>ions<br />
to vote. The judge of elections must<br />
permit w<strong>at</strong>chers to inspect but not mark <strong>the</strong><br />
voting check list and ei<strong>the</strong>r of <strong>the</strong> numbered<br />
lists of voters maintained by <strong>the</strong> county<br />
board.<br />
25 PA. STAT. ANN. § 2687<br />
Overseers of <strong>the</strong> election are also permitted<br />
to challenge any person <strong>at</strong>tempting to vote,<br />
examine <strong>the</strong> voter’s papers, and ask <strong>the</strong> voter<br />
and <strong>the</strong> voter’s witnesses, under o<strong>at</strong>h, about<br />
his or her right to vote in th<strong>at</strong> election.<br />

Each candid<strong>at</strong>e <strong>at</strong> any election may appoint<br />
two w<strong>at</strong>chers for each election district<br />
in which he or she is running, and<br />
each political party th<strong>at</strong> has nomin<strong>at</strong>ed<br />
candid<strong>at</strong>es may appoint three w<strong>at</strong>chers<br />
<strong>at</strong> any general, municipal or special election<br />
for each election district in which<br />
its candid<strong>at</strong>es are competing.<br />

Each w<strong>at</strong>cher receives a certific<strong>at</strong>e from<br />
<strong>the</strong> county board of elections, st<strong>at</strong>ing<br />
his name and <strong>the</strong> name of <strong>the</strong> candid<strong>at</strong>e,<br />
party or political body he represents.<br />
W<strong>at</strong>chers are required to show certific<strong>at</strong>es<br />
upon request.<br />

Overseers of <strong>the</strong> election are appointed<br />
on <strong>the</strong> petition of five or more duly<br />
registered electors of any election district.<br />
The court of common pleas of <strong>the</strong><br />
proper county must <strong>the</strong>n appoint two<br />
judicious, sober and intelligent electors<br />
of <strong>the</strong> said district belonging to different<br />
political parties.<br />
