challenges is very protective of voters’<br />
rights and guards against wrongful<br />
challenges to voters’ eligibility on<br />

w<strong>at</strong>chers inside <strong>the</strong> polling place may<br />
still result in viol<strong>at</strong>ions of voters’<br />

Allowing any voter to challenge<br />
o<strong>the</strong>r voters eligibility to vote may<br />
burden an individuals’ right to vote.<br />
It is preferable to limit challengers to<br />
those individuals who reside in <strong>the</strong><br />
precinct. Additionally, <strong>the</strong> evidentiary<br />
requirements for initi<strong>at</strong>ing challenges<br />
in Virginia are too low.<br />
However, Virginia law does have<br />
good procedural protections: any<br />
challenged voter can vote a regular<br />
ballot upon signing a sworn st<strong>at</strong>ement<br />
affirming her voter qualific<strong>at</strong>ions.<br />
The challenger must fill out a form, subject to<br />
penalties, st<strong>at</strong>ing th<strong>at</strong> it is “known or suspected”<br />
th<strong>at</strong> <strong>the</strong> challenged voter is not a citizen, a<br />
resident, of age, has already voted elsewhere,<br />
is disqualified by <strong>the</strong> st<strong>at</strong>e (e.g. due to a felony<br />
conviction), or is not who she represents<br />
herself to be.<br />

The election offices may examine <strong>the</strong> challenged<br />
voter’s qualific<strong>at</strong>ions. The challenged<br />
voter <strong>the</strong>n has <strong>the</strong> opportunity to sign a st<strong>at</strong>ement,<br />
subject to felony perjury charges, th<strong>at</strong><br />
he or she meets all of <strong>the</strong> qualific<strong>at</strong>ions for<br />
voting in <strong>the</strong> st<strong>at</strong>e. Upon signing <strong>the</strong> st<strong>at</strong>ement,<br />
<strong>the</strong> voter shall be permitted to vote on<br />
<strong>the</strong> voting system in use <strong>at</strong> <strong>the</strong> precinct. If he<br />
or she refuses to sign <strong>the</strong> st<strong>at</strong>ement, he or she<br />
is not permitted to vote.<br />
