Ohio’s laws are protective of voters’<br />

rights because eligibility may only<br />

be challenged on Election Day by an<br />

elections judge.<br />

However, Ohio could improve its<br />

laws by specifying th<strong>at</strong> <strong>the</strong> burden<br />

of proof is not on <strong>the</strong> voter, and by<br />

allowing <strong>the</strong> voter to vote a regular<br />

ballot once she or he signs an affirm<strong>at</strong>ion<br />

th<strong>at</strong> she or he is eligible to<br />

vote.<br />

Depending on <strong>the</strong> grounds for challenge and<br />

voters’ responses to <strong>the</strong> election judges’ questions,<br />

election judges are instructed to ei<strong>the</strong>r<br />

ask follow up questions or request document<strong>at</strong>ion,<br />

identific<strong>at</strong>ion, or a st<strong>at</strong>ement under o<strong>at</strong>h<br />

from <strong>the</strong> voter <strong>at</strong>testing to his or her qualific<strong>at</strong>ions.<br />

If <strong>the</strong> election official is unable to<br />

verify th<strong>at</strong> <strong>the</strong> voter qualific<strong>at</strong>ions have been<br />

met, <strong>the</strong>y must provide a provisional ballot,<br />

which will only be counted once <strong>the</strong> board of<br />

elections determines th<strong>at</strong> <strong>the</strong> voter is properly<br />

registered and eligible to vote.<br />

Voters who are able to provide <strong>the</strong> election<br />

official with proof or document<strong>at</strong>ion of <strong>the</strong>ir<br />

eligibility may vote a regular ballot. Those<br />

who cannot must vote by provisional ballot.<br />

The grounds for presenting a challenge<br />

include: (1) The person is not a<br />

citizen of <strong>the</strong> United St<strong>at</strong>es; (2) The<br />

person is not a resident of <strong>the</strong> st<strong>at</strong>e<br />

for thirty days immedi<strong>at</strong>ely preceding<br />

election; (3) The person is not<br />

a resident of <strong>the</strong> precinct where <strong>the</strong><br />

person offers to vote; (4) The person<br />

is not of legal voting age.<br />

vote provisionally.<br />

Pennsylvania could also improve its<br />

laws by limiting <strong>the</strong> number of people<br />

who can challenge voters’ eligibility.<br />

Pennsylvania should require th<strong>at</strong><br />

a challenge be in writing under o<strong>at</strong>h,<br />

based on personal knowledge and<br />

accompanied by supporting evidence,<br />

with penalties for frivolous<br />

challenges.<br />

If a voter is challenged as to his or her identity<br />

or residence, he or she shall produce <strong>at</strong> least<br />

one qualified elector of <strong>the</strong> election district as<br />

a witness, who can make an affidavit of his<br />

or her identity or continued residence in <strong>the</strong><br />

election district.<br />

An overseer may challenge any person <strong>at</strong>tempting<br />

to vote. The overseer may “examine”<br />

<strong>the</strong> voter’s papers and ask <strong>the</strong> voter and<br />

<strong>the</strong> voter’s witnesses, under o<strong>at</strong>h, about his or<br />

her right of to vote in th<strong>at</strong> election.<br />
