It is excellent th<strong>at</strong> challenges must<br />

be made in writing under o<strong>at</strong>h, and<br />

th<strong>at</strong> voters have an opportunity to<br />

respond. Ano<strong>the</strong>r protective fe<strong>at</strong>ure<br />

of Colorado law is th<strong>at</strong> challenged<br />

voters may vote a regular ballot after<br />

signing an affidavit. Colorado also<br />

limits excessive challenges by only<br />

allowing individuals from <strong>the</strong> same<br />

precinct to serve as challengers.<br />

Colorado could improve its laws by<br />

requiring th<strong>at</strong> a challenge be based<br />

on personal knowledge, supported<br />

by documentary evidence, and th<strong>at</strong><br />

<strong>the</strong> burden of proof is on <strong>the</strong> challenger.<br />

There should also be a penalty<br />

for making a frivolous challenge.<br />

Challenges must be made in writing, under<br />

o<strong>at</strong>h and signed by <strong>the</strong> challenger under<br />

penalty of perjury and must contain a “specific<br />

factual basis for <strong>the</strong> challenge.”<br />

<strong>the</strong> person whose right to vote is challenged.<br />

A challenged voter may be asked follow-up<br />

may vote a regular ballot. If <strong>the</strong> voter does<br />

not answer <strong>the</strong> questions he may still vote a<br />

However, it is very problem<strong>at</strong>ic th<strong>at</strong><br />

all challenged voters are required<br />

to vote provisionally. This could<br />

endanger <strong>the</strong> rights of any challenged<br />

Florida voter from casting a ballot<br />

should be able to vote a regular<br />

Grounds for challenging an elector<br />

include age, citizenship, legal residence<br />

in <strong>the</strong> st<strong>at</strong>e and <strong>the</strong> appropri<strong>at</strong>e<br />

county, and <strong>the</strong> voter’s registr<strong>at</strong>ion<br />

st<strong>at</strong>us.<br />

counted unless <strong>the</strong> canvassing board determines<br />

by a preponderance of <strong>the</strong> evidence th<strong>at</strong><br />

<strong>the</strong> person was not entitled to vote.<br />
