and request proof of eligibility. Giving <strong>the</strong> w<strong>at</strong>cher <strong>the</strong><br />

discretion to initi<strong>at</strong>e challenges on <strong>the</strong> basis of a voter<br />

list poses a large risk of discrimin<strong>at</strong>ory challenges.<br />

Particularly in light of Pennsylvania’s newly passed<br />

Voter ID law, <strong>the</strong> power to examine a voter’s papers<br />

and o<strong>the</strong>rwise interrog<strong>at</strong>e voters gives w<strong>at</strong>chers and<br />

overseers a lot of power in an interaction with a voter,<br />

which could prove troublesome.<br />

Texas law does not allow a person to challenge a<br />

person’s registr<strong>at</strong>ion or ability to vote <strong>at</strong> a polling place<br />

on Election Day. 322<br />

In Texas, poll w<strong>at</strong>chers can be appointed<br />

to observe <strong>the</strong> conduct of election. 323 To be eligible<br />

to serve as a w<strong>at</strong>cher, a person must be a qualified<br />

voter of <strong>the</strong> county and political subdivision in<br />

which he or she will serve in a st<strong>at</strong>ewide election. 324<br />

Candid<strong>at</strong>es, chairs of political parties, or, in <strong>the</strong> case<br />

of a write-in candid<strong>at</strong>e, a group of registered voters<br />

may appoint two w<strong>at</strong>chers for each voting loc<strong>at</strong>ion. 325<br />

The appointment must be in writing, and <strong>the</strong><br />

appointing officials or voters must issue a certific<strong>at</strong>e of<br />

appointment to <strong>the</strong> appointee and obtain an affidavit<br />

st<strong>at</strong>ing th<strong>at</strong> <strong>the</strong> appointee will not have possession of<br />

a device capable of recording images or sound or th<strong>at</strong><br />

<strong>the</strong> appointee will disable or deactiv<strong>at</strong>e <strong>the</strong> device while<br />

serving as a w<strong>at</strong>cher. 326 This provision is good. The<br />

w<strong>at</strong>cher must deliver <strong>the</strong> certific<strong>at</strong>e of appointment<br />

to <strong>the</strong> presiding judge <strong>at</strong> <strong>the</strong> polling place and must<br />

counter-sign it to verify th<strong>at</strong> <strong>the</strong> w<strong>at</strong>cher is <strong>the</strong> same<br />

person who signed <strong>the</strong> certific<strong>at</strong>e.<br />

A w<strong>at</strong>cher is entitled to be near <strong>the</strong> election<br />

officers <strong>at</strong> <strong>the</strong> polls, and members of <strong>the</strong> counting team<br />

when votes are being counted, inspect <strong>the</strong> returns, and<br />

make written notes while on duty. 327 An election judge<br />

<strong>at</strong> a central counting st<strong>at</strong>ion must allow w<strong>at</strong>chers to<br />

perform <strong>the</strong> activities described in <strong>the</strong> Texas Election<br />

Code, but <strong>the</strong> judge also has <strong>the</strong> authority to limit<br />

excessive or disruptive activity. 328<br />

A w<strong>at</strong>cher is entitled to observe any activities<br />

conducted <strong>at</strong> <strong>the</strong> loc<strong>at</strong>ion he or she is serving, except<br />

th<strong>at</strong> <strong>the</strong> w<strong>at</strong>cher may not be present <strong>at</strong> <strong>the</strong> voting<br />

st<strong>at</strong>ion when a voter is preparing a ballot without<br />

assistance from an election officer. 329 However,<br />

The need for enforcement<br />

In 2010, reports surfaced th<strong>at</strong> “[p]oll w<strong>at</strong>chers in Harris<br />

County … were accused of ‘hovering over’ voters,<br />

‘getting into election workers’ faces’ and blocking or<br />

disrupting lines of voters who were waiting to cast<br />

<strong>the</strong>ir ballots.” 339 The county <strong>at</strong>torney’s office and <strong>the</strong><br />

county clerk’s office took no action beyond initial<br />

investig<strong>at</strong>ions. 340 Fortun<strong>at</strong>ely, o<strong>the</strong>r reports indic<strong>at</strong>e<br />

th<strong>at</strong> <strong>the</strong> Department of Justice was investig<strong>at</strong>ing <strong>the</strong><br />

m<strong>at</strong>ter, including witness interviews. 341 In a public<br />

st<strong>at</strong>ement, <strong>the</strong> Department’s Civil Rights Division<br />

confirmed its efforts to g<strong>at</strong>her inform<strong>at</strong>ion about Harris<br />

County poll w<strong>at</strong>cher intimid<strong>at</strong>ion, but charges were<br />

never brought. 342 n<br />

w<strong>at</strong>chers are entitled to be present <strong>at</strong> <strong>the</strong> voting st<strong>at</strong>ion<br />

when a voter is being assisted by an election officer and<br />

are entitled to examine <strong>the</strong> ballot before it is deposited<br />

in <strong>the</strong> ballot box to determine whe<strong>the</strong>r it is prepared<br />

in accordance with <strong>the</strong> voter’s wishes. 330 This is very<br />

problem<strong>at</strong>ic. This inspection requirement endangers <strong>the</strong><br />

secrecy of a voter’s ballot.<br />

While on duty, a w<strong>at</strong>cher may not converse<br />

with an election officer regarding <strong>the</strong> election, except<br />

to call <strong>at</strong>tention to an irregularity or viol<strong>at</strong>ion of law,<br />

nor may <strong>the</strong>y converse with voters or communic<strong>at</strong>e<br />

in any manner with a voter regarding <strong>the</strong> election. 331<br />

It is protective of voting rights to prohibit voter<br />

communic<strong>at</strong>ion by <strong>the</strong> poll w<strong>at</strong>chers. Of course,<br />

for this provision to be effective, enforcement is<br />

critical. As noted, troubling alleg<strong>at</strong>ions about poll<br />

w<strong>at</strong>cher behavior in Harris County, Texas makes this<br />

obvious. 332<br />

A w<strong>at</strong>cher may bring any occurrence th<strong>at</strong> <strong>the</strong><br />

w<strong>at</strong>cher believes to be an irregularity or viol<strong>at</strong>ion<br />

of law to <strong>the</strong> <strong>at</strong>tention of an election officer. 333 The<br />

w<strong>at</strong>cher may discuss <strong>the</strong> m<strong>at</strong>ter with <strong>the</strong> officer, and<br />

<strong>the</strong> officer may refer <strong>the</strong> w<strong>at</strong>cher to <strong>the</strong> presiding<br />

officer <strong>at</strong> any point in <strong>the</strong> discussion. 334 In th<strong>at</strong> case, <strong>the</strong><br />

w<strong>at</strong>cher may no longer discuss <strong>the</strong> occurrence with <strong>the</strong><br />
