fraud is rampant in minority precincts and used th<strong>at</strong><br />

fear to justify <strong>the</strong>ir discrimin<strong>at</strong>ory targeting of pollw<strong>at</strong>ching<br />

efforts – again, without evidence to support<br />

<strong>the</strong> targeting. 21<br />

As recently as July 31, 2012, True <strong>the</strong> Vote<br />

reportedly mailed letters to 160 counties alleging<br />

th<strong>at</strong> <strong>the</strong>y were not compliant with <strong>the</strong> N<strong>at</strong>ional<br />

Voter Registr<strong>at</strong>ion Act (“NVRA”) for failing to<br />

conduct voter registr<strong>at</strong>ion list maintenance programs<br />

in advance of <strong>the</strong> November elections. 22 A True<br />

<strong>the</strong> Vote spokesperson st<strong>at</strong>ed th<strong>at</strong> <strong>the</strong> organiz<strong>at</strong>ion<br />

did not “expect <strong>the</strong>se [notices] to go ignored” and<br />

th<strong>at</strong> it “expects <strong>the</strong> counties to take proper action<br />

to clean <strong>the</strong>ir voter rolls well before Election Day<br />

in November.” 23 True <strong>the</strong> Vote demanded proof of<br />

compliance with <strong>the</strong>ir demand for vote-cleaning<br />

prior to <strong>the</strong> election o<strong>the</strong>rwise <strong>the</strong>y would commence<br />

litig<strong>at</strong>ion. 24<br />

There is nothing wrong with wanting accur<strong>at</strong>e<br />

voter rolls. However, True <strong>the</strong> Vote’s notices are <strong>at</strong><br />

odds with <strong>the</strong> very st<strong>at</strong>ute <strong>the</strong>y claim to be enforcing,<br />

because <strong>the</strong> NVRA requires th<strong>at</strong> any general list<br />

maintenance program resulting in <strong>the</strong> system<strong>at</strong>ic<br />

removal of names of ineligible voters must be<br />

completed no l<strong>at</strong>er than 90 days before Election Day. 25<br />

The reason such list maintenance programs must be<br />

completed <strong>at</strong> least 90 days before <strong>the</strong> election is to<br />

ensure th<strong>at</strong> removal notices do not confuse eligible<br />

voters about <strong>the</strong>ir registr<strong>at</strong>ion st<strong>at</strong>us so soon before an<br />

election. To be clear, election officials in <strong>the</strong> counties<br />

where True <strong>the</strong> Vote “expects to take proper action …<br />

well before Election Day in November” would viol<strong>at</strong>e<br />

<strong>the</strong> NVRA should <strong>the</strong>y conduct a purge within 90 days<br />

of <strong>the</strong> election. 26<br />

The repe<strong>at</strong>ed use of caging in recent election<br />

cycles, <strong>the</strong> emergence of priv<strong>at</strong>e groups th<strong>at</strong> organized<br />

to target communities of color for voter challenges in<br />

2010, <strong>the</strong> avowed plans of <strong>the</strong> King Street P<strong>at</strong>riots and<br />

True <strong>the</strong> Vote to massively expand <strong>the</strong>se activities in<br />

2012, and <strong>the</strong> high stakes of <strong>the</strong> upcoming presidential<br />

election, all provide clear warning th<strong>at</strong> pre-election and<br />

polling place challenges may see unprecedented use<br />

in this election year. No m<strong>at</strong>ter who is organizing or<br />

leading <strong>the</strong> charge, it is important th<strong>at</strong> all participants<br />

understand <strong>the</strong> rules and respect <strong>the</strong> right of all<br />

Americans to vote free of intimid<strong>at</strong>ion or obstruction.<br />

history oF wrongFul<br />

Challenges anD intimiD<strong>at</strong>ion<br />

The practice of individuals challenging <strong>the</strong> rights<br />

of voters to cast a ballot <strong>at</strong> <strong>the</strong> polling place has a<br />

troubled history in American elections. 31 There was a<br />

serious resurgence of <strong>the</strong> practice in <strong>the</strong> 2004 election,<br />

and, in 2010, <strong>the</strong> confront<strong>at</strong>ional approach of certain<br />

parts of <strong>the</strong> Tea Party movement moved dangerously<br />

into <strong>the</strong> polling areas. The following examples<br />

illustr<strong>at</strong>e th<strong>at</strong> all too often plans to challenge voters<br />

th<strong>at</strong> are implemented in <strong>the</strong> name of voting integrity<br />

are really tactics meant to seek electoral advantage by<br />

manipul<strong>at</strong>ing <strong>the</strong> voter pool.<br />

In 1982 <strong>the</strong> Democr<strong>at</strong>ic N<strong>at</strong>ional Committee<br />

(DNC) alleged in a lawsuit against <strong>the</strong> Republican<br />

N<strong>at</strong>ional Committee (RNC) th<strong>at</strong> <strong>the</strong> RNC was<br />

engaging in discrimin<strong>at</strong>ory voter caging and voter<br />

intimid<strong>at</strong>ion efforts focused on predominantly African<br />

American and L<strong>at</strong>ino neighborhoods. 32 The parties<br />

eventually entered into a consent decree, important<br />

parts of which remain in effect today, which forbade<br />

<strong>the</strong> n<strong>at</strong>ional RNC from engaging in voter caging<br />

oper<strong>at</strong>ions. 33<br />

In spite of <strong>the</strong> consent decree, Republicans were<br />

reportedly planning to use vote caging in 2004. 34 A<br />

document developed in part by a lawyer for <strong>the</strong> Bush-<br />

Cheney campaign and distributed for use by st<strong>at</strong>e GOP<br />

officials provided a templ<strong>at</strong>e for vote caging; an email<br />

from <strong>the</strong> same lawyer noted th<strong>at</strong> Nevada was one of<br />

<strong>the</strong> st<strong>at</strong>es where caging was possible, because <strong>the</strong>y<br />

had a list which could be used for th<strong>at</strong> purpose. 35 The<br />

effort to identify registered voters to challenge in st<strong>at</strong>es<br />

like Nevada was described by <strong>the</strong> Washington Post as<br />

“<strong>the</strong> most robust in recent history.” 36 A former st<strong>at</strong>e<br />

Republican Party executive director <strong>at</strong>tempted to cage<br />

and challenge over 17,000 voters in Nevada prior to<br />

Election Day, but election administr<strong>at</strong>ors rejected <strong>the</strong><br />

mass challenge. 37<br />

After <strong>the</strong> 2004 election, detailed plans to<br />

challenge <strong>the</strong> eligibility of voters who were expected<br />

to support Democr<strong>at</strong>ic presidential candid<strong>at</strong>e John<br />

Kerry in key swing st<strong>at</strong>es were discovered in 43 pages
