(5) For the avoidance <strong>of</strong> doubt it is hereby declared that where any person charged with<br />

stealing anything or with any other <strong>of</strong>fence under any other section <strong>of</strong> this <strong>Code</strong> is acquitted, he<br />

may be subsequently charged and tried for an <strong>of</strong>fence under this section only if the subsequent<br />

charge under this section is based on acts or omissions related to those upon which the<br />

previous charge was based.<br />

(6) Where the court convicts a person <strong>of</strong> an <strong>of</strong>fence under this section, the court shall order<br />

that person to pay the specified authority compensation <strong>of</strong> an amount not exceeding the<br />

amount <strong>of</strong> the actual loss incurred by the specified authority and in assessing the compensation<br />

the court shall have regard to any extenuating circumstance it may consider relevant.<br />

(7) Where an order is made under subsection (6) the specified authority in whose favour the<br />

order is made may file an authenticated copy <strong>of</strong> the order in the district court having jurisdiction<br />

over the area over which the court which made the order has jurisdiction, and upon being so<br />

filed the order shall be deemed to be a decree passed by that district court and may be<br />

executed in the same manner as if it were a decree passed under the provisions <strong>of</strong> the Civil<br />

Procedure <strong>Code</strong> *(18), and the district court shall have jurisdiction to execute the decree<br />

notwithstanding that the amount <strong>of</strong> the compensation awarded exceeds its pecuniary<br />

jurisdiction.<br />

285. Definition <strong>of</strong> robbery<br />

CHAPTER XXIX<br />

ROBBERY AND EXTORTION (ss 285-292)<br />

Any person who steals anything and, at or immediately before or immediately after the time<br />

<strong>of</strong> stealing it, uses or threatens to use actual violence to any person or property in order to<br />

obtain or retain the thing stolen or to prevent or overcome resistance to its being stolen or<br />

retained is guilty <strong>of</strong> robbery.<br />

286. Punishment for robbery<br />

Any person who commits robbery is liable to imprisonment for twenty years and if the<br />

<strong>of</strong>fender is armed with any dangerous or <strong>of</strong>fensive weapon or instrument, or is in company with<br />

any other person or if, at or immediately before or immediately after the time <strong>of</strong> robbery, he<br />

wounds, beats, strikes or uses personal violence to any person, he is liable to imprisonment for<br />

life, with or without corporal punishment.<br />

287. Attempted robbery<br />

(1) Any person who assaults another with intent to steal anything, and, at or immediately<br />

before or immediately after the time <strong>of</strong> assault, uses or threatens to use actual violence to any<br />

person or property in order to obtain the thing intended to be stolen, or to prevent or overcome<br />

resistance to its being stolen, is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for a term <strong>of</strong><br />

not less than seven years and not exceeding twenty years, with corporal punishment.
