245. Definition <strong>of</strong> kidnapping from lawful guardianship<br />
Any person who takes or entices another person under fourteen years <strong>of</strong> age if a male, or<br />
under sixteen years <strong>of</strong> age if a female, or any person <strong>of</strong> unsound mind, out <strong>of</strong> the keeping <strong>of</strong><br />
the lawful guardian <strong>of</strong> the minor or person <strong>of</strong> unsound mind, without the consent <strong>of</strong> the<br />
guardian, is said to kidnap that person from lawful guardianship.<br />
246. Definition <strong>of</strong> abduction<br />
A person who by force compels, or by deceitful means induces, any person to go from any<br />
place is said to abduct that person.<br />
247. Punishment for kidnapping<br />
A person who kidnaps any other person from Mainland <strong>Tanzania</strong> or from lawful guardianship<br />
is guilty <strong>of</strong> an <strong>of</strong>fence and liable to imprisonment for seven years.<br />
248. Kidnapping or abducting in order to murder<br />
Any person who kidnaps or abducts a person in order that that person may be murdered, or<br />
may be so disposed <strong>of</strong> as to be put in danger <strong>of</strong> being murdered, is guilty <strong>of</strong> an <strong>of</strong>fence and is<br />
liable to imprisonment for ten years.<br />
249. Kidnapping or abducting with intent to confine<br />
Any person who kidnaps or abducts a person with intent to cause that person to be secretly<br />
and wrongfully confined is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for seven years.<br />
250. Kidnapping or abducting with intent to do harm<br />
Any person who kidnaps or abducts another in order that that other person may be<br />
subjected, or may be so disposed <strong>of</strong> as to be put in danger <strong>of</strong> being subjected, to grievous<br />
harm, or slavery, or to the unnatural lust <strong>of</strong> any person, or knowing it to be likely that the person<br />
will be so subjected or disposed <strong>of</strong>, is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for ten<br />
years.<br />
251. Wrongfully concealing kidnapped or abducted person<br />
Any person who, knowing that any person has been kidnapped or has been abducted,<br />
wrongfully conceals or confines that person, is guilty <strong>of</strong> an <strong>of</strong>fence, and shall be punished in the<br />
same manner as if he had kidnapped or abducted that person with the same intention or<br />
knowledge, or for the same purpose, as that with or for which he conceals or detains the person<br />
in confinement.
