without lawful excuse fails to do so, whereby the life <strong>of</strong> that other person is or is likely to be<br />

endangered or his health is or is likely to be permanently injured, is guilty <strong>of</strong> an <strong>of</strong>fence and<br />

liable to imprisonment for three years.<br />

230. Responsibility as to surgical operation<br />

A person is not criminally responsible for performing, in good faith and with reasonable care<br />

and skill, a surgical operation upon any person for his benefit, or upon an unborn child for the<br />

preservation <strong>of</strong> the mother's life if the performance <strong>of</strong> the operation is reasonable, having<br />

regard to the patient's state at the time and to all the circumstances <strong>of</strong> the case.<br />

231. <strong>Criminal</strong> responsibility for excess force<br />

Any person authorised by law or by the consent <strong>of</strong> the person injured by him to use force is<br />

criminally responsible for any excess according to the nature and quality <strong>of</strong> the act which<br />

constitutes the excess.<br />

232. Effect <strong>of</strong> victim's consent on criminal responsibility for death or maim<br />

Notwithstanding anything contained in section 231 consent by a person to the causing <strong>of</strong> his<br />

own death or his own maim does not affect the criminal responsibility <strong>of</strong> any person by whom<br />

the death or maim is caused.<br />

CHAPTER XXIV<br />

CRIMINAL RECKLESSNESS AND NEGLIGENCE (ss 233-239)<br />

233. Reckless and negligent acts<br />

Any person who in a manner so rash or negligent as to endanger human life or to be likely to<br />

cause harm to any other person–<br />

(a) drives any vehicle or rides on any public way;<br />

(b) navigates, or takes part in the navigation or working <strong>of</strong> any vessel;<br />

(c) does any act with fire or any combustible matter, or omits to take precautions against<br />

any probable danger from any fire or any combustible matter in his possession;<br />

(d) omits to take precautions against any probable danger from any animal in his<br />

possession;<br />

(e) gives medical or surgical treatment to any person whom he has undertaken to treat;<br />

(f) dispenses, supplies, sells, administers or gives away any medicine or poisonous or<br />

dangerous matter;<br />

(g) does any act with respect to, or omits to take proper precautions against, any probable
