the provisions <strong>of</strong> any law, including any by-law, in force in Mainland <strong>Tanzania</strong>:<br />

Provided further that for the purposes <strong>of</strong> paragraph (e) <strong>of</strong> this section, the definition "public<br />

place" in section 5 <strong>of</strong> this <strong>Code</strong> shall not be deemed to include any recognised place <strong>of</strong> religious<br />

worship.<br />

177A. Failure to account for money collected by public subscription<br />

Subject to the provisions <strong>of</strong> any other law, including any by-law, any person, whether or not<br />

he has received any written consent referred to in the first proviso to section 177, or has been<br />

authorised as in paragraph (a) or (b) <strong>of</strong> that proviso who, having collected or procured to be<br />

collected money by subscription in Mainland <strong>Tanzania</strong> fails, if and when required so to do by<br />

District Commissioner, or in the case <strong>of</strong> an urban authority by the police <strong>of</strong>ficer in-charge <strong>of</strong> the<br />

Police in that authority, either to produce to the District Commissioner or the police <strong>of</strong>ficer, or to<br />

publish in a newspaper designated by the District Commissioner or the police <strong>of</strong>ficer, as he may<br />

be required, full and correct accounts <strong>of</strong> any money received by subscription and <strong>of</strong> its disposal,<br />

shall be guilty <strong>of</strong> an <strong>of</strong>fence and liable for the first <strong>of</strong>fence to imprisonment for two years and for<br />

every subsequent <strong>of</strong>fence, to imprisonment for three years.<br />

178. <strong>of</strong>fences relating to uniforms<br />

(1) Any person who, not being a person serving in the Defence Forces <strong>of</strong> the United<br />

Republic or in any police force established by law, wears without the permission <strong>of</strong> the<br />

President the uniform <strong>of</strong> any <strong>of</strong> those forces or any attire having the appearance or bearing any<br />

<strong>of</strong> the regimental or other distinctive marks <strong>of</strong> such uniform or attire is guilty <strong>of</strong> an <strong>of</strong>fence and<br />

liable to imprisonment for one month or to a fine <strong>of</strong> two hundred shillings:<br />

Provided that nothing in this section shall prevent any person from wearing any uniform or<br />

attire in the course <strong>of</strong> a stage play performed in any place in which stage plays may lawfully be<br />

publicly performed, or in the course <strong>of</strong> a music hall or circus performance, or in the course <strong>of</strong><br />

any bona fide military representation.<br />

(2) Any person who unlawfully wears the uniform or attire <strong>of</strong> any <strong>of</strong> the forces referred to in<br />

subsection (1), or any dress having the appearance or bearing any <strong>of</strong> the regimental or other<br />

distinctive marks <strong>of</strong> the uniform, in such a manner or in such circumstances as to be likely to<br />

bring contempt on that uniform, or employs any other person so to wear the uniform or dress, is<br />

guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for three months or to a fine <strong>of</strong> four hundred<br />

shillings:<br />

(3) Any person who, not being in the service <strong>of</strong> the United Republic or not having previously<br />

received the written permission <strong>of</strong> the Inspector-General or Police so to do, imports or sells or<br />

has in his possession for sale any uniform or the buttons or badges appropriate to it, is guilty <strong>of</strong><br />

an <strong>of</strong>fence and is liable to imprisonment for six months or to a fine <strong>of</strong> two thousand shillings.<br />
