shall be deemed to be an idle and disorderly person and shall be liable to a fine not exceeding<br />

five hundred shillings or to imprisonment for a period not exceeding three months or to both the<br />

fine and imprisonment.<br />

176A. Harbouring common prostitutes<br />

Any person who, being the keeper <strong>of</strong> any bar, hotel, house, shop, room or other place <strong>of</strong><br />

public resort for the sale or consumption <strong>of</strong> refreshments <strong>of</strong> any kind, knowingly permits or<br />

suffers common prostitutes to assemble at and remain on his premises for the purpose <strong>of</strong><br />

prostitution, shall be guilty <strong>of</strong> an <strong>of</strong>fence and liable on conviction to a fine not exceeding five<br />

hundred shillings or, in the case <strong>of</strong> a second or subsequent <strong>of</strong>fence, to a fine not exceeding one<br />

thousand shillings.<br />

177. Rogues and vagabonds<br />

Any <strong>of</strong> the following persons–<br />

(a) a person convicted <strong>of</strong> an <strong>of</strong>fence under section 176 after having been previously<br />

convicted as an idle and disorderly person;<br />

(b) a person going about as gatherer or collector <strong>of</strong> alms, or endeavouring to procure<br />

charitable contributions <strong>of</strong> any nature or kind, under any false or fraudulent pretence;<br />

(c) a suspected person or reputed thief who has no visible means <strong>of</strong> subsistence and<br />

cannot give a good account <strong>of</strong> himself;<br />

(d) a person found in or upon or near any premises or in any road or highway or any place<br />

adjacent thereto or in any public place at such time and under such circumstances as<br />

to lead to the conclusion that such person is there for an illegal or disorderly purpose;<br />

or<br />

(e) a person who, without the prior consent in writing in that behalf <strong>of</strong> the District<br />

Commissioner, or, in the case <strong>of</strong> an urban authority, the police <strong>of</strong>ficer in charge <strong>of</strong> the<br />

police in that authority, collects, or makes any appeal for subscriptions <strong>of</strong> money in any<br />

public place for any purpose,<br />

shall be deemed to be a rogue and vagabond, and shall be guilty <strong>of</strong> an <strong>of</strong>fence and liable for<br />

the first <strong>of</strong>fence to imprisonment for three months, and for every subsequent <strong>of</strong>fence to<br />

imprisonment for one year:<br />

Provided that paragraph (e) <strong>of</strong> this section shall not apply to–<br />

(a) any person who, or the duly authorised representative <strong>of</strong> any organisation which, has<br />

received the written consent <strong>of</strong> the Inspector-General <strong>of</strong> Police to collect, or make any<br />

appeal for, subscription <strong>of</strong> money for religious or charitable purposes; or<br />

(b) any person authorised to collect or make any appeal for subscriptions <strong>of</strong> money under
