thousand shillings and not exceeding three hundred thousand shillings or to both the fine and<br />
imprisonment and shall in addition be ordered to pay compensation <strong>of</strong> an amount to be<br />
determined by the court, to the person in respect <strong>of</strong> whom the <strong>of</strong>fence was committed.<br />
(2) In this section "child" means a person <strong>of</strong> the age <strong>of</strong> eighteen years and less.<br />
140. Procuring rape<br />
Any person who–<br />
(a) by any threats or intimidation procures or attempts to procure any girl or woman to<br />
have any prohibited sexual intercourse inside or outside the United Republic; or<br />
(b) by false pretences or false representations procures, any girl or woman to have<br />
prohibited sexual intercourse anywhere inside or outside the United Republic; or<br />
(c) applies, administers to, or causes to be taken by any girl or woman any drug, matter or<br />
thing with intent to stupefy or overpower her so as thereby to enable any man to have<br />
prohibited sexual intercourse with her,<br />
commits an <strong>of</strong>fence and is liable on conviction to a fine <strong>of</strong> not less than one hundred thousand<br />
shillings and not exceeding three hundred thousand shillings or imprisonment for a term <strong>of</strong> not<br />
less than ten years and not exceeding twenty years or to both the fine and imprisonment and<br />
shall be ordered to pay for an amount to be determined by the court.<br />
141. Householder, etc., permitting defilement <strong>of</strong> girl under twelve years <strong>of</strong> age on his<br />
premises<br />
Any person who, being the owner or occupier <strong>of</strong> premises or having or acting or assisting in<br />
the management or control there<strong>of</strong>, induces or knowingly suffers any woman under the age <strong>of</strong><br />
fifteen years to resort to or be upon those premises for the purpose <strong>of</strong> sexual intercourse with<br />
any man whether such sexual intercourse is intended to be with any particular man or generally,<br />
is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for five years:<br />
Provided that it shall be a sufficient defence to a charge under this section if it is made to<br />
appear to the court before which that person is charged that he had reasonable cause to<br />
believe and did in fact believe that the woman was <strong>of</strong> or above the age <strong>of</strong> twelve years.<br />
142. Householder, etc., permitting defilement <strong>of</strong> girl under sixteen years <strong>of</strong> age on his<br />
premises<br />
Any person who, being the owner or occupier <strong>of</strong> premises or having or acting or assisting in<br />
the management or control there<strong>of</strong>, induces or knowingly suffers any woman above the age <strong>of</strong><br />
fifteen years and under the age <strong>of</strong> sixteen years to resort to or be upon the premises for the<br />
purpose <strong>of</strong> unlawful sexual intercourse with a man, whether such intercourse intended to be<br />
with any particular man or generally, is guilty <strong>of</strong> an <strong>of</strong>fence:
