RESCUES, ESCAPES AND OBSTRUCTING OFFICERS OF COURT OF LAW (ss 115-119)<br />

115. Rescue<br />

(1) Any person, who by force rescues or attempts to rescue from lawful custody any other<br />

person–<br />

(a) if that other person is under sentence <strong>of</strong> death or imprisonment for life, or charged with<br />

an <strong>of</strong>fence punishable with death or imprisonment for life is guilty <strong>of</strong> an <strong>of</strong>fence and<br />

liable to imprisonment for life;<br />

(b) if that other person is imprisoned on a charge or under sentence for any <strong>of</strong>fence other<br />

than those referred to in paragraph (a), is guilty <strong>of</strong> an <strong>of</strong>fence and liable to<br />

imprisonment for seven years; or<br />

(c) in any other case,<br />

is guilty <strong>of</strong> an <strong>of</strong>fence.<br />

(2) If the person rescued is in the custody <strong>of</strong> a private person, the <strong>of</strong>fender must have notice<br />

<strong>of</strong> the fact that the person rescued is in such custody.<br />

116. Escape from lawful custody<br />

A person who escapes from lawful custody is guilty <strong>of</strong> an <strong>of</strong>fence.<br />

116A. Absence from extramural employment<br />

(1) If any person who has received permission to work outside a prison pursuant to the<br />

provisions <strong>of</strong> the Prisons Act *(13), fails to present himself at the appointed hour or absents<br />

himself from work, he is guilty <strong>of</strong> an <strong>of</strong>fence unless he satisfies the court that he had a<br />

reasonable and lawful excuse for so doing.<br />

(2) A sentence <strong>of</strong> imprisonment imposed for an <strong>of</strong>fence against subsection (1) shall be in<br />

addition to any imprisonment to which the person sentenced is already liable and which he is<br />

ordered to suffer under the Prisons Act.<br />

117. Aiding prisoners to escape<br />

A person who–<br />

(a) aids a prisoner in escaping or attempting to escape from lawful custody; or<br />

(b) conveys anything or causes anything to be conveyed into a prison with intent to<br />

facilitate the escape <strong>of</strong> a prisoner,<br />

is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for seven years.
