"injury" includes injury to a person in respect <strong>of</strong> his business, occupation, employment or<br />

other source <strong>of</strong> income and also includes any actionable wrong.<br />

(3) A person shall not be prosecuted for an <strong>of</strong>fence under this section without the written<br />

consent <strong>of</strong> the Director <strong>of</strong> Public Prosecutions.<br />

89C. Dissuading persons from assisting with self-help schemes<br />

(1) Any person who, with intent to impede, obstruct, prevent or defeat any self-help scheme<br />

or type <strong>of</strong> self-help scheme approved by the Regional Commissioner or the District<br />

Commissioner, dissuades or attempts to dissuade any person from <strong>of</strong>fering his services, or<br />

from assisting, in connection therewith, shall be guilty <strong>of</strong> an <strong>of</strong>fence and liable on conviction to a<br />

fine not exceeding one thousand shillings or to imprisonment for a term not exceeding six<br />

months or to both such fine and imprisonment.<br />

(2) In any prosecution for an <strong>of</strong>fence against this section the certificate <strong>of</strong> the Regional<br />

Commissioner or the District Commissioner, as the case may be, that a self-help scheme<br />

named or described therein was approved by him on a specified date or that self-help schemes<br />

<strong>of</strong> the type described therein were approved by him on or before a specified date, shall be<br />

conclusive evidence <strong>of</strong> such facts.<br />

90. Assembling for the purpose <strong>of</strong> smuggling<br />

Any two or more persons who assemble together for the purpose <strong>of</strong> unshipping, carrying, or<br />

concealing any goods subject to customs duty and liable to forfeiture under any law relating to<br />

the customs are guilty <strong>of</strong> an <strong>of</strong>fence and each <strong>of</strong> them is liable to imprisonment for two years.<br />

94. Officers charged with administration <strong>of</strong> property <strong>of</strong> a special character with special<br />

duties<br />

Any person who, being employed in the public service, and being charged by virtue <strong>of</strong> his<br />

employment with any judicial or administrative duties respecting property <strong>of</strong> a special character,<br />

or respecting the carrying on <strong>of</strong> any manufacture, trade or business <strong>of</strong> a special character, and<br />

or having acquired or holding, directly or indirectly, a private interest duties in any such<br />

property, manufacture, trade or business, discharges any such duties with respect to the<br />

property, manufacture, trade, or business in which he has such interest or with respect to the
