any member <strong>of</strong> the Police Force, Prisons Service or National Service, is guilty <strong>of</strong> an <strong>of</strong>fence and<br />
is liable to imprisonment for six months.<br />
48. Aiding prisoners <strong>of</strong> war to escape<br />
Any person who–<br />
(a) knowingly and advisedly aids an enemy <strong>of</strong> the Republic who is a prisoner <strong>of</strong> war,<br />
whether the prisoner is confined in a prison or elsewhere, or is suffered to be at large<br />
on his parole, to escape from his prison or place <strong>of</strong> confinement, or if he is at large on<br />
his parole, to escape from Mainland <strong>Tanzania</strong>, is guilty <strong>of</strong> an <strong>of</strong>fence, and is liable to<br />
imprisonment for life;<br />
(b) negligently and unlawfully permits the escape <strong>of</strong> any person referred to in paragraph<br />
(a) is guilty <strong>of</strong> an <strong>of</strong>fence.<br />
49. Definition <strong>of</strong> overt act<br />
In the case <strong>of</strong> any <strong>of</strong> the <strong>of</strong>fences set out in this Chapter, when the manifestation by an overt<br />
act <strong>of</strong> the intention to effect any purpose is an element <strong>of</strong> the <strong>of</strong>fence, every act <strong>of</strong> conspiring<br />
with any person to effect that purpose and every act done in furtherance <strong>of</strong> the purpose by any<br />
<strong>of</strong> the persons conspiring is deemed to be an overt act manifesting the intention.<br />

55. Seditious intention<br />
(1) A seditious intention is an intention to–<br />
(a) bring into hatred or contempt or to excite disaffection against the lawful authority <strong>of</strong> the<br />
United Republic or its Government;<br />
(b) excite any <strong>of</strong> the inhabitants <strong>of</strong> the United Republic to attempt to procure the alteration,<br />
otherwise than by lawful means, <strong>of</strong> any other matter in the United Republic as by law<br />
established;<br />
(c) bring into hatred or contempt or to excite disaffection against the administration <strong>of</strong><br />
justice in the United Republic; or<br />
(d) raise discontent or disaffection amongst any <strong>of</strong> the inhabitants <strong>of</strong> the United Republic;<br />
(e) promote feelings <strong>of</strong> ill-will and hostility between different classes <strong>of</strong> the population <strong>of</strong><br />
the United Republic.<br />
(2) An act, speech or publication is not seditious by reason only that it intends to–
