(3) It is immaterial that by reason <strong>of</strong> circumstances not known to the <strong>of</strong>fender it is impossible<br />
in fact to commit the <strong>of</strong>fence.<br />
381. Attempt to commit <strong>of</strong>fences<br />
Any person who attempts to commit an <strong>of</strong>fence is guilty <strong>of</strong> an <strong>of</strong>fence for which, unless a<br />
different punishment is provided, he is liable to imprisonment for two years or a fine or both.<br />
382. Punishment <strong>of</strong> attempts to commit <strong>of</strong>fences<br />
Any person who attempts to commit an <strong>of</strong>fence <strong>of</strong> such a kind that a person convicted <strong>of</strong> it is<br />
liable to the punishment <strong>of</strong> death or imprisonment for a term <strong>of</strong> fourteen years or more, with or<br />
without other punishment, is guilty <strong>of</strong> an <strong>of</strong>fence and is liable, if no other punishment is<br />
provided, to imprisonment for seven years.<br />
383. Neglect to prevent <strong>of</strong>fence<br />
Every person who knowing that a person designs to commit or is committing an <strong>of</strong>fence, fails<br />
to use all reasonable means to prevent the commission or completion there<strong>of</strong>, is guilty <strong>of</strong> an<br />
<strong>of</strong>fence.<br />

CONSPIRACIES (ss 384-386)<br />
384. Conspiracy to commit <strong>of</strong>fence punishable with imprisonment for three or more<br />
years <strong>of</strong> imprisonment<br />
Any person who conspires with another to commit any <strong>of</strong>fence, punishable with<br />
imprisonment for a term <strong>of</strong> three years or more, or to do any act in any part <strong>of</strong> world which if<br />
done in <strong>Tanzania</strong> would be an <strong>of</strong>fence so punishable, and which is an <strong>of</strong>fence under the laws in<br />
force in the place where it is proposed to be done, is guilty <strong>of</strong> an <strong>of</strong>fence, and is liable if no<br />
other punishment is provided, to imprisonment for seven years or, if the greatest punishment to<br />
which a person convicted <strong>of</strong> the <strong>of</strong>fence in question is liable is less than imprisonment for seven<br />
years, then to such lesser punishment.<br />
385. Conspiracy to commit an <strong>of</strong>fence punishable with imprisonment for less than three<br />
years<br />
Any person who conspires with another to commit an <strong>of</strong>fence punishable with imprisonment<br />
for a term <strong>of</strong> less than three years, or to do any act in any part <strong>of</strong> the world which if done in<br />
<strong>Tanzania</strong> would be, an <strong>of</strong>fence so punishable, and which is an <strong>of</strong>fence under the laws in force<br />
in the place where it is proposed to be done, is guilty <strong>of</strong> an <strong>of</strong>fence.<br />
386. Other conspiracies<br />
