372. Lending, etc., certificate for personation<br />

Any person who, being a person to whom any document has been issued by lawful authority<br />

whereby he is certified to be a person possessed <strong>of</strong> any qualification recognised by law for any<br />

purpose, or to be the holder <strong>of</strong> any <strong>of</strong>fice, or to be entitled to exercise any pr<strong>of</strong>ession, trade or<br />

business, or to be entitled to any right or privilege, or to enjoy any rank or status, sells, gives or<br />

lends the document to another person with intent that that other person may represent himself<br />

to be the person named therein, is guilty <strong>of</strong> an <strong>of</strong>fence.<br />

373. Personation <strong>of</strong> a person named in testimonial <strong>of</strong> character<br />

Any person who, for the purpose <strong>of</strong> obtaining any employment, utters any document <strong>of</strong> the<br />

nature <strong>of</strong> a testimonial character given to another person, is guilty <strong>of</strong> an <strong>of</strong>fence, and is liable to<br />

imprisonment for one year.<br />

374. Lending, etc., testimonial for personation<br />

Any person who, being a person to whom any such document as is mentioned in section 373<br />

has been given, gives, sells or lends such document to another person with intent that that<br />

other person may utter the document for the purpose <strong>of</strong> obtaining any employment, is guilty <strong>of</strong><br />

an <strong>of</strong>fence.<br />

ATTEMPTS (ss 380-383)<br />

(1) When a person, intending to commit an <strong>of</strong>fence, begins to put his intention into execution<br />

by means adapted to its fulfilment, and manifests his intention by some overt act, but does not<br />

fulfil his intention to such extent as to commit the <strong>of</strong>fence, he is deemed to attempt to commit<br />

the <strong>of</strong>fence.<br />

(2) It is immaterial, except so far as regards punishment, whether the <strong>of</strong>fender does all that<br />

is necessary on his part for completing the commission <strong>of</strong> the <strong>of</strong>fence, or whether the complete<br />

fulfilment <strong>of</strong> his intention is prevented by circumstances independent <strong>of</strong> his will, or whether he<br />

desists <strong>of</strong> his own motion from the further prosecution <strong>of</strong> his intention.
