(d) wilfully molests, hinders or obstructs the <strong>of</strong>ficer in charge <strong>of</strong> any railway or his<br />

assistants or workmen in the execution <strong>of</strong> any work done or to be done in reference to<br />

the construction or maintenance <strong>of</strong> the railway,<br />

is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for three months or to a fine <strong>of</strong> four hundred<br />

shillings.<br />

332. Threats to burn or destroy<br />

Any person who, knowing the contents there<strong>of</strong>, sends, delivers, utters or directly or indirectly<br />

causes to be received any letter or writing threatening to burn or destroy any house, barn or<br />

other building or any rick or stack <strong>of</strong> grain, hay or straw, or other agricultural produce, whether<br />

in or under any building or not, or any vessel, or to kill, maim or wound any cattle, is guilty <strong>of</strong> an<br />

<strong>of</strong>fence and is liable to imprisonment for seven years.<br />

332A. Defacing bank notes<br />

Any person who, without authority, wilfully defaces, tears, cuts or otherwise mutilates any<br />

bank note or currency note which is legal tender, is guilty <strong>of</strong> an schedule <strong>of</strong>fence and is liable<br />

on conviction to a fine <strong>of</strong> five thousand shillings for each note defaced or, in default, to<br />

imprisonment for a term <strong>of</strong> one year.<br />

332B. Kite-flying<br />

(1) Subject to subsection (3), any person who fraudulently obtains credit or money <strong>of</strong> any<br />

amount from a banker by means <strong>of</strong> kite-flying is guilty <strong>of</strong> an <strong>of</strong>fence and liable on conviction to<br />

imprisonment for a term not exceeding ten years.<br />

(2) Any person employed by a bank who, by virtue <strong>of</strong> his <strong>of</strong>fice, fraudulently assists another<br />

person to obtain credit or money <strong>of</strong> any amount from a bank by means <strong>of</strong> kite-flying is guilty <strong>of</strong><br />

an <strong>of</strong>fence and shall be liable on conviction to imprisonment for a term not exceeding ten years.<br />

(3) A person shall be presumed fraudulent and guilty <strong>of</strong> an <strong>of</strong>fence under this section if the<br />

cheque drawn by him is not honoured for reason <strong>of</strong> lack or insufficiency <strong>of</strong> funds in the account<br />

and within eight days after he is informed <strong>of</strong> the dishonoured cheque he fails or refuses to<br />

make good on the account.<br />

(4) Where any person is convicted <strong>of</strong> an <strong>of</strong>fence under this section the court shall order the<br />

forfeiture to the United Republic <strong>of</strong> any money, goods or property obtained in the course <strong>of</strong> or<br />

after the commission <strong>of</strong> the <strong>of</strong>fence, as well as full compensation to the bank in respect <strong>of</strong> the<br />

money involved in the kite-flying.<br />

(5) For the purposes <strong>of</strong> this section the expression "kite-flying" means obtaining money or<br />

credit by cheque on an account which has insufficient or no funds at all, thereby causing an<br />

unauthorised overdraft to a banker.
