Any person who is found under any <strong>of</strong> the following circumstances, namely–<br />

(a) being armed with any dangerous or <strong>of</strong>fensive weapon or instrument, and being so<br />

armed with intent to break or enter a dwelling house, and to commit an <strong>of</strong>fence therein;<br />

(b) being armed at night in the manner referred to in paragraph (a) with intent to break or<br />

enter any building whatever and to commit a an <strong>of</strong>fence therein;<br />

(c) having in his possession by night without lawful excuse, the pro<strong>of</strong> <strong>of</strong> which lies on him,<br />

any instrument <strong>of</strong> housebreaking;<br />

(d) having in his possession by day any instrument <strong>of</strong> house breaking with intent to<br />

commit an <strong>of</strong>fence;<br />

(e) having his face masked or blackened or being otherwise disguised, with intent to<br />

commit an <strong>of</strong>fence; or<br />

(f) being in any building whatever by day or night with intent to commit an <strong>of</strong>fence therein,<br />

is guilty <strong>of</strong> an <strong>of</strong>fence and is liable to imprisonment for five years or, if he has been previously<br />

convicted <strong>of</strong> an <strong>of</strong>fence relating to property, he is liable to imprisonment for fourteen years.<br />

299. <strong>Criminal</strong> trespass<br />

Any person who–<br />

(a) unlawfully enters into or upon property in the possession <strong>of</strong> another with intent to<br />

commit an <strong>of</strong>fence or to intimidate, insult or annoy any person in possession <strong>of</strong> the<br />

property; or<br />

(b) having lawfully entered into or upon the property unlawfully remains there with intent<br />

thereby to intimidate, insult or annoy the person in possession <strong>of</strong> the property or with<br />

intent to commit an <strong>of</strong>fence,<br />

is guilty <strong>of</strong> criminal trespass and liable to imprisonment for three months; if the property upon<br />

which the <strong>of</strong>fence is committed is any building, tent or vessel used as a human dwelling or any<br />

building used as a place <strong>of</strong> worship or as a place for the custody <strong>of</strong> property, the <strong>of</strong>fender is<br />

liable to imprisonment for one year.<br />

300. Forfeiture<br />

When any person is convicted <strong>of</strong> an <strong>of</strong>fence under this Chapter the court may order that any<br />

dangerous <strong>of</strong> <strong>of</strong>fensive weapon or instrument <strong>of</strong> housebreaking carried or used in connection<br />

with the <strong>of</strong>fence shall be forfeited to the United Republic.<br />
