: Violations <strong>of</strong> provisions <strong>of</strong> Mineral Conservation & Development Rules, 1988<br />
(MCDR, 1988) in respect <strong>of</strong> your Bhandarbodi Manganese Ore Mine over an area <strong>of</strong><br />
4.86 Ha. situated in Nagpur district, Maharashtra State.<br />

Please refer to the inspection <strong>of</strong> your above mentioned mine carried out by a team <strong>of</strong> Task<br />
Force consisting <strong>of</strong> Sh.B.L.Kotriwala, Deputy Controller Of <strong>Mines</strong> & Team leader and Sh. Abhay<br />
Agrawal, Sr. Assistant Controller Of <strong>Mines</strong> & member, on 08.03.2011, accompanied by Dr.S.P.Awale,<br />
Sr. Geologist, from Directorate <strong>of</strong> Geology and Mining, Govt. <strong>of</strong> Maharashtra.<br />
02. During the inspection, the following provisions <strong>of</strong> Mineral Conservation & Development<br />
Rules, 1988 (MCDR’88) were found violated in respect <strong>of</strong> your above referred mine:-<br />

Rule No. Nature <strong>of</strong> Violation<br />
13(1) Every holder <strong>of</strong> a mining lease shall carry out mining operations in accordance with the<br />
approved mining plan with such conditions as may have been prescribed under sub rule (2) <strong>of</strong><br />
rule 9 or with such modifications, if any, as permitted under rule 10 or the mining plan or<br />
scheme <strong>of</strong> mining as approved under rule 11 or 12 as the case may be.<br />
During inspection it was observed that, mining operations are not carried out as per the Mining<br />
Plan, approved vide letter no. NAG/MN/MPLN-933/NGP dt. 29/05/2006. The following<br />
provisions were found violated :-<br />
i) As per para 3.3(ii), there is an approved exploration proposal for digging 2 trial pits and 3<br />
inclined bore holes which is to be completed by the year 2008-09; but the same has not<br />
been carried out.<br />
ii) As per the approved Mining plan mining operations are approved to be done by manual<br />
means. Drilling <strong>of</strong> 34mm dia. blast holes, are approved to be done by deploying jack
hammer. During inspection, machineries like tyre mounted wagon drill for drilling 100mm<br />
dia. blast hole and JCB excavator was found deployed in the lease area.<br />
iii) As per para 7.2 & plate 6, there is an approved proposal for dumping the waste along<br />
the N-W side <strong>of</strong> the pit. During inspection it was noticed that the waste dumping is not done<br />
at the proposed site and the waste is dumped along the N-E side <strong>of</strong> the pit.<br />
iv) As per para 12.3 there is an approved proposal for planting 25 trees per year. However<br />
no plantation as approved has been carried out in the area.<br />
v) It is revealed from the lease deed that the lease has been executed and registered for an<br />
area <strong>of</strong> 4.86 hect. whereas the mining operations has been carried out over an area <strong>of</strong> 6.68<br />
hect. as per the plates in the approved document.<br />
23(E)(2) The owner, agent, manager or mining engineer shall submit to the Regional Controller <strong>of</strong><br />
<strong>Mines</strong> or the <strong>of</strong>ficer authorized by the State Government in this behalf, as the case may be,<br />
a yearly report before 1 st July <strong>of</strong> every year setting forth the extent <strong>of</strong> protective and<br />
rehabilitative works carried out as envisaged in the approved mine closure plan, and if there<br />
is any deviation, reasons there<strong>of</strong>. The same has not been submitted.<br />

03. In this connection, it is brought to your notice that the above violations constitute an <strong>of</strong>fence<br />
punishable under rule 58 <strong>of</strong> MCDR, 1988.<br />
04. You are therefore directed to show cause within a period <strong>of</strong> 30 (thirty) days from the date <strong>of</strong> issue<br />
<strong>of</strong> this letter, as to why mining operations in the mine should not be suspended in accordance to<br />
rule 13(2) for violation <strong>of</strong> rule 13(1) <strong>of</strong> the MCDR, 1988.<br />
05. Please note that no further notice will be given to you in this regard.<br />
