: Violations of provisions of Mineral Conservation & Development Rules, 1988
(MCDR, 1988) in respect of your Bhandarbodi Manganese Ore Mine over an area of
4.86 Ha. situated in Nagpur district, Maharashtra State.

Please refer to the inspection of your above mentioned mine carried out by a team of Task
Force consisting of Sh.B.L.Kotriwala, Deputy Controller Of Mines & Team leader and Sh. Abhay
Agrawal, Sr. Assistant Controller Of Mines & member, on 08.03.2011, accompanied by Dr.S.P.Awale,
Sr. Geologist, from Directorate of Geology and Mining, Govt. of Maharashtra.
02. During the inspection, the following provisions of Mineral Conservation & Development
Rules, 1988 (MCDR’88) were found violated in respect of your above referred mine:-

Rule No. Nature of Violation
13(1) Every holder of a mining lease shall carry out mining operations in accordance with the
approved mining plan with such conditions as may have been prescribed under sub rule (2) of
rule 9 or with such modifications, if any, as permitted under rule 10 or the mining plan or
scheme of mining as approved under rule 11 or 12 as the case may be.
During inspection it was observed that, mining operations are not carried out as per the Mining
Plan, approved vide letter no. NAG/MN/MPLN-933/NGP dt. 29/05/2006. The following
provisions were found violated :-
i) As per para 3.3(ii), there is an approved exploration proposal for digging 2 trial pits and 3
inclined bore holes which is to be completed by the year 2008-09; but the same has not
been carried out.
ii) As per the approved Mining plan mining operations are approved to be done by manual
means. Drilling of 34mm dia. blast holes, are approved to be done by deploying jack

hammer. During inspection, machineries like tyre mounted wagon drill for drilling 100mm
dia. blast hole and JCB excavator was found deployed in the lease area.
iii) As per para 7.2 & plate 6, there is an approved proposal for dumping the waste along
the N-W side of the pit. During inspection it was noticed that the waste dumping is not done
at the proposed site and the waste is dumped along the N-E side of the pit.
iv) As per para 12.3 there is an approved proposal for planting 25 trees per year. However
no plantation as approved has been carried out in the area.
v) It is revealed from the lease deed that the lease has been executed and registered for an
area of 4.86 hect. whereas the mining operations has been carried out over an area of 6.68
hect. as per the plates in the approved document.
23(E)(2) The owner, agent, manager or mining engineer shall submit to the Regional Controller of
Mines or the officer authorized by the State Government in this behalf, as the case may be,
a yearly report before 1 st July of every year setting forth the extent of protective and
rehabilitative works carried out as envisaged in the approved mine closure plan, and if there
is any deviation, reasons thereof. The same has not been submitted.

03. In this connection, it is brought to your notice that the above violations constitute an offence
punishable under rule 58 of MCDR, 1988.
04. You are therefore directed to show cause within a period of 30 (thirty) days from the date of issue
of this letter, as to why mining operations in the mine should not be suspended in accordance to
rule 13(2) for violation of rule 13(1) of the MCDR, 1988.
05. Please note that no further notice will be given to you in this regard.
