<strong>Health</strong> systems in transition <strong>Canada</strong> 59<br />

Provinces and territories are allowed to require patients to get consent from<br />

their home jurisdiction be<strong>for</strong>e seeking elective (non-emergency) medicare<br />

services in another province or country. Within <strong>Canada</strong>, the portability<br />

provisions of the <strong>Canada</strong> <strong>Health</strong> Act are implemented through a series of<br />

bilateral billing agreements between the provinces and territories <strong>for</strong> hospital<br />

and physician services. All provinces and territories participate in hospital<br />

reciprocal billing and all, with the exception of Quebec, participate in reciprocal<br />

medical agreements. To date, the federal government has chosen not to en<strong>for</strong>ce<br />

this breach of the portability condition (Flood & Choudhry, 2004).
