established by Congress <strong>in</strong> such areas as civil rights of <strong>in</strong>stitutionalized<br />

persons, vot<strong>in</strong>g rights, fair hous<strong>in</strong>g, and sex discrim<strong>in</strong>ation. The<br />

American Civil Liberties Union reports that as a result of <strong>the</strong><br />

Adm<strong>in</strong>istration’s refusal to adhere to “<strong>the</strong> constitutional requirement to<br />

enforce civil rights laws,” <strong>the</strong> ACLU has been forced to handle about<br />

80% of all vot<strong>in</strong>g rights cases <strong>in</strong> <strong>the</strong> deep South,” act<strong>in</strong>g <strong>in</strong> effect as a<br />

“private attorney general,” an impossible burden. This “conservative”<br />

Adm<strong>in</strong>istration posture guarantees, as <strong>in</strong>tended, that <strong>the</strong> laws will not be<br />

enforced.” 14 “Conservative” lawlessness is not limited to <strong>in</strong>ternational<br />

affairs.<br />

The Adm<strong>in</strong>istration is, however, not entirely <strong>in</strong>active <strong>in</strong> <strong>the</strong> matter of<br />

vot<strong>in</strong>g rights. It is conduct<strong>in</strong>g extensive <strong>in</strong>vestigations of vot<strong>in</strong>g fraud <strong>in</strong><br />

Alabama, all <strong>in</strong> <strong>the</strong> “Black Belt” where blacks have recently ga<strong>in</strong>ed local<br />

political power as a result of <strong>the</strong>ir enfranchisement a mere two centuries<br />

after <strong>the</strong> American revolution. These actions are plac<strong>in</strong>g <strong>the</strong> area <strong>in</strong> “a<br />

state of political siege and almost legal tyranny,” <strong>in</strong> <strong>the</strong> words of<br />

Lawrence Wofford of <strong>the</strong> Campaign for a New South, an organization<br />

devoted to promot<strong>in</strong>g black vot<strong>in</strong>g strength. The government had at this<br />

po<strong>in</strong>t lost all its cases, 15 but this hardly matters, s<strong>in</strong>ce <strong>the</strong> assault on<br />

black politics will serve its purpose of discourag<strong>in</strong>g black voters and<br />

underm<strong>in</strong><strong>in</strong>g activists. Democratic Representative Don Edwards of<br />

California suggested that government officials “have been misused by<br />

whites attempt<strong>in</strong>g to thwart black political advances”—a far too<br />

charitable <strong>in</strong>terpretation. One can imag<strong>in</strong>e what <strong>the</strong> Justice Department<br />

would f<strong>in</strong>d if it were to carry out comparable <strong>in</strong>vestigations of white-run<br />

counties <strong>in</strong> that region or elsewhere. 16<br />

The attack on civil liberties is one facet of a broad campaign to<br />

restore <strong>in</strong>equity and discrim<strong>in</strong>ation overcome to a degree <strong>in</strong> <strong>the</strong> past<br />

generation. The attack on labor also renews major <strong>the</strong>mes of US history,
