<strong>The</strong> views <strong>of</strong> the district judges we <strong>in</strong>terviewed about these diffe<strong>rent</strong> sources <strong>of</strong> tra<strong>in</strong><strong>in</strong>g and<br />
updat<strong>in</strong>g varied considerably. Generally speak<strong>in</strong>g, the longer a judge had been sitt<strong>in</strong>g, the<br />
less likely they were to make use <strong>of</strong> web-based material and the less enthusiasm they<br />
showed for refresher tra<strong>in</strong><strong>in</strong>g. Some experienced district judges may feel that further tra<strong>in</strong><strong>in</strong>g<br />
is unnecessary; for example:<br />
“I receive the tra<strong>in</strong><strong>in</strong>g that is adm<strong>in</strong>istered to me. I go <strong>in</strong> for a de-coke regularly.”<br />

However, most <strong>of</strong> the district judges <strong>in</strong>terviewed felt that the tra<strong>in</strong><strong>in</strong>g provided was useful, if<br />
limited:<br />
“<strong>The</strong> job lacks tra<strong>in</strong><strong>in</strong>g overall, quite frankly. It’s, <strong>in</strong> my view, the tra<strong>in</strong><strong>in</strong>g that we<br />
receive is very <strong>of</strong>ten euphemistic. You know, you can get a day...for someth<strong>in</strong>g<br />
completely new.” (DJ G)<br />
<strong>The</strong>re was also a range <strong>of</strong> op<strong>in</strong>ions about the difficulty <strong>in</strong>volved <strong>in</strong> this area <strong>of</strong> law. One<br />
district judge described it as “a technical area” and was concerned that some judges might<br />
not “understand about notices and th<strong>in</strong>gs, and actually make the wrong decisions, possibly”<br />
(DJ H). At the other end <strong>of</strong> this range <strong>of</strong> views, two other district judges felt that: “It’s easy to<br />
keep yourself up to date. It’s not an obscure area at all.” (DJ L); and that: “I can’t imag<strong>in</strong>e<br />
hous<strong>in</strong>g possessions produce any problems at all” (DJ T).<br />
Although there were considerable variations <strong>in</strong> attitudes to tra<strong>in</strong><strong>in</strong>g and updat<strong>in</strong>g, it was not<br />
possible to see that these views affected <strong>in</strong> any way the pattern <strong>of</strong> diffe<strong>rent</strong> outcomes<br />
suggested by district judges to the scenarios that were put to them <strong>in</strong> the <strong>in</strong>terviews.<br />
Judges’ views on consistency and difference<br />
Most <strong>of</strong> the judges <strong>in</strong>terviewed considered that consistency – both with<strong>in</strong> one court and<br />
across courts – was important. However, their views varied as to whether it was achievable,<br />
or had already been achieved, one view be<strong>in</strong>g that: “It’s never occurred to me there could be<br />
any <strong>in</strong>consistency <strong>in</strong> possession proceed<strong>in</strong>gs” (DJ T). Most <strong>of</strong> the district judges <strong>in</strong>terviewed<br />
