<strong>The</strong> <strong>exercise</strong> <strong>of</strong> <strong>judicial</strong> <strong>discretion</strong> <strong>in</strong> <strong>rent</strong> <strong>arrears</strong> <strong>cases</strong><br />

This study is concerned with how judges <strong>exercise</strong> their <strong>discretion</strong> <strong>in</strong> <strong>cases</strong> where social landlords<br />

seek possession aga<strong>in</strong>st their secure or assured tenants on the ground <strong>of</strong> <strong>rent</strong> <strong>arrears</strong>. Through <strong>in</strong>terviews<br />

with district judges, as well as observation <strong>of</strong> <strong>cases</strong> and exam<strong>in</strong>ation <strong>of</strong> court files it exam<strong>in</strong>es:<br />

• the factors which <strong>in</strong>fluence the orders which judges make <strong>in</strong> hous<strong>in</strong>g possession <strong>cases</strong>;<br />

• how far there is a consistency <strong>of</strong> approach between district judges.<br />

A wide and diverse range <strong>of</strong> factors was reported by judges as be<strong>in</strong>g <strong>in</strong>fluential <strong>in</strong> how they <strong>exercise</strong>d<br />

their <strong>discretion</strong> <strong>in</strong> <strong>in</strong>dividual <strong>cases</strong>.<br />
