indefinitely, provide flexibility for innovati<strong>on</strong> and improvement within traditi<strong>on</strong>al c<strong>on</strong>text,<br />

allow meaningful participati<strong>on</strong> of local communities, help developing and c<strong>on</strong>solidating niche<br />

markets, and can be used to localize c<strong>on</strong>trol. Whereas demerits are that GIs protecti<strong>on</strong> does<br />

not prevent selling of similar products, extend to services, methods and process (limit to<br />

products and their indicati<strong>on</strong>), requires instituti<strong>on</strong>al infrastructure (associati<strong>on</strong> of producers,<br />

administrative and quality c<strong>on</strong>trol, enforcement and c<strong>on</strong>trol of misuse), requires str<strong>on</strong>g<br />

promoti<strong>on</strong> and marketing, and that internati<strong>on</strong>al protecti<strong>on</strong> requires prior protecti<strong>on</strong> in the<br />

7.3.1) C<strong>on</strong>straints to a GI implementati<strong>on</strong> in <strong>Limu</strong><br />

Excludability and rivalry<br />

Excludability reflects the possibilities of excluding an individual from enjoying the<br />

benefits of a good. A n<strong>on</strong>-excludable good means that every<strong>on</strong>e can enjoy and/or access the<br />

good without payment. Rivalry relates to the distributi<strong>on</strong> of benefits between c<strong>on</strong>sumers of<br />

the good and whether an individual’s c<strong>on</strong>sumpti<strong>on</strong> of the good rivals similar c<strong>on</strong>sumpti<strong>on</strong> by<br />

other individuals. Club goods are largely n<strong>on</strong> rivalrous in c<strong>on</strong>sumpti<strong>on</strong> but excludable; thus<br />

being a local public good for those who enjoy membership of the club. Thus the specificati<strong>on</strong>s<br />

defining the GIs are the c<strong>on</strong>diti<strong>on</strong>s that must be met to allow producers to use an indicati<strong>on</strong><br />

(excludability) but allowing for the use of the indicati<strong>on</strong> by an additi<strong>on</strong>al producer does not<br />

involve significant additi<strong>on</strong>al costs (n<strong>on</strong>-rivalry). In this way, GIs can be said club goods,<br />

which are public goods.<br />

GI protecti<strong>on</strong> is premised <strong>on</strong> the c<strong>on</strong>diti<strong>on</strong> that the product can not be produced in a<br />

different physical/human envir<strong>on</strong>ment. The ambiguity linking a product to a defined area, as it<br />

is for <strong>Limu</strong> <strong>coffee</strong>, is likely to exclude producers that could benefit from it, and more<br />

c<strong>on</strong>sequently exclude producers that formerly benefited from the name. In this way, GIs<br />

products turn rivalrous clashing the former club of producers and excluding some producers<br />
