Simonson Lumber is a family owned company which has been serving the Minnesota community
for 100 years. Before the lumber yards began in 1913 we operated a butcher shop, drove a
stagecoach, and ran a sawmill/logging business which evolved into the lumber yard.

Ken Retka and Deb Retka’s father, Jerry Retka, purchased his first ServiceMaster franchise in Little Falls and

Action Graphics is a family owned business that recently
celebrated its 20th anniversary in the Brainerd Lakes Area.

specializes in logo design, vehicle graphics, custom wraps,

In addition, the company is deeply involved in the
snowmobile industry, creating multi-media projects for a
number of the manufacturers, aftermarket businesses and professional racing teams. One unique feature of the
companies shop is an 80’ drive thru bay with 14’ overhead doors that will accommodate any vehicle.
Owners Gary and verena Walton started the company in 1992 at the dawn of the computer graphics revolution.
There have been many changes in the way vinyl graphics are produced since that time and Action Graphics has
always stayed at the leading edge of new technology. A large percent of their signs and graphics are printed on a
single layer with protective laminate and are far superior in quality and durability to the layers of colored vinyl
used in the past.
Builders and contractors have always been an integral part of Action Graphics’ customer base and the company
joined MMBA not only as a way to stay in contact with those customers and trends, but to also be a part of the
numerous community projects the association promotes and carries out.

This year’s legislative session started January
8th and it must conclude by May 20 th
according to the constitution. With 64 new
legislators the pace of session will undoubtedly
start slow. BAM will be working
hard to educate the legislature about the industry’s
issues and communicate that a
healthy housing industry means a healthy
economy and jobs.
The past few years BAM has built positive
relationships with both Democrats and Republicans,
rural and metro, across the state
that understand our priorities. During the
election season, BAM put together a list of
housing-friendly candidates on both sides
of the aisle and targeted those individuals
for BAM-PAC donations. Of those candidates,
31 of our 37 were elected. For the
first time since 1990, Democrats are in
control of the House, the Senate, and the
governor’s office, and so our relationships

Minnesota’s 2013
Legislative Session Is In
CODES
In addition to the legislative session, BAM
is fighting a mandate of fire sprinklers in
single-family construction in the upcoming
residential building code. The legislature
voted overwhelmingly to remove the mandate
from the code in 2011 and 2012, but
was vetoed by the Governor citing homeowner
and fire fighter safety. It was also
voted out of the code twice by the Department
of Labor and Industry’s advisory code
committee. However, the mandate was unfortunately
put in the recent draft code by
the department at a 4,500 square foot trigger.
The code draft is slated to be published
by the Department of Labor and Industry in
March after which BAM will fight the
mandate in the Administrative Law Judge
process.
All new codes in Minnesota are enacted at
the same time, and currently they are slated
to go into effect in late 2013 with a beginning
enforcement date of six months later -
in the spring of 2014.

The Builders Association of Minnesota (BAM) is pleased to

vice president effective January 16, 2013. Stone brings more than
20 years of extensive experience with the Minnesota state
government and the construction industry to her new role having
previously worked as a lobbyist, practicing attorney, and director
of government affairs for several organizations in 23 states and
Washington D.C.
“We welcome Remi’s experience and leadership to the BAM
community,” said Chad Kompelien, 2013 BAM President. “She
has a unique knowledge of the homebuilding industry, our
association, the legislative process, our issues, and a unique
perspective of subcontractors, suppliers, building officials,
regulators and municipalities across the state. In her new role as
executive vice president, she will be responsible for extending
BAM’s excellent reputation at the State Capitol and delivering
value to the statewide membership.”
Stone has experience representing the Residential Subcontractors
and Suppliers and the Association of Subcontractors, the statewide
building officials association (AMBO), the League of Minnesota
Cities and the Coalition of Greater Minnesota Cities, and the
Builders Association of Minnesota and the Builders Association of
the Twin Cities. Stone most recently served as the regional director
of government affairs for MillerCoors Brewing Company. Earlier
in her career, Stone served as Planning Commissioner for the City

of Roseville and committee administrator to Minnesota State
Senator Jim vickerman.
Stone earned bachelor’s degrees in political science and sociology
from the University of Wisconsin, Eau Claire, and served in the
United States Air Force, Minnesota Air National Guard. Stone also
earned a juris doctorate from the Hamline University School of
Law where she currently serves as an adjunct professor.

Builder Confidence
Holds Steady in January
January 16, 2013 - Builder confidence in the market for
newly built, single-family homes was unchanged in January,
remaining at a level of 47 on the National Association of
Home Builders/Wells Fargo Housing Market Index, released
today. This means that following eight consecutive monthly
gains, the index continues to hold at its highest level since
April of 2006.
“Conditions in the housing market look much better now than
at the beginning of 2012 and an increasing number of housing
markets are showing signs of recovery, which should bode
well for future home sales later this year,” said Barry
Rutenberg, chairman of the National Association of Home
Builders (NAHB) and a home builder from Gainesville, Fla.
“However, uncertainties stemming from last month’s fiscal
cliff negotiations contributed to the pause in builder
confidence and continuing discussions among policymakers
related to spending cuts and the future of the mortgage interest
deduction could put a damper on housing demand in the
coming months.”
“Builders’ sentiment remains very close to the index’s tipping
point of 50, where an equal number of builders view
conditions as good and poor, and fundamentals indicate
continued momentum in housing this year,” said NAHB Chief
Economist David Crowe. “However, persistently tight
mortgage credit conditions, difficulties in obtaining accurate
appraisals and the ongoing stalemate in Washington over
critical economic concerns continue to impede the housing
recovery.”

Derived from a monthly survey that NAHB has been
conducting for 25 years, the NAHB/Wells Fargo Housing
Market Index gauges builder perceptions of current singlefamily
home sales and sales expectations for the next six
months as “good,” “fair” or “poor.” The survey also asks
builders to rate traffic of prospective buyers as “high to very
high,” “average” or “low to very low.” Scores from each
component are then used to calculate a seasonally adjusted
index where any number over 50 indicates that more builders
view conditions as good than poor.
The index’s components were mixed in January. The
component gauging current sales conditions remained
unchanged at 51. Meanwhile, the component gauging sales
expectations in the next six months fell one point to 49 and
the component gauging traffic of prospective buyers gained
one point to 37.
The HMI three-month moving average was up across all
regions, with the Northeast and Midwest posting a two-point
gain to 36 and 50, respectively. The South registered a threepoint
gain to 49 and the West posted a four-point increase to 51.

Online licensing, renewals
show positive results
New license applications and license renewals for all
CCLD license types can now be submitted online, reducing
the time it takes to process applications and issue
licenses.
In 2012, 36 percent of all license renewals were submitted
online, compared to about 12 percent in 2011. Twothirds
of all plumbing licenses were renewed online this
year.
Personal licenses renewed online are automatically and
immediately renewed without the submission of supporting
documents as long as the licensee has completed
required continuing education prior to going online to
submit the renewal.
Continuing education information is now submitted directly
to CCLD by the continuing education providers,
eliminating the need for licensees to submit course completion
certificates with license renewals. Licensees
who try to renew a license without completing the required
continuing education are subject to license suspension
or revocation and a fine of up to $10,000.
Currently, business license applicants are still required
to complete paper application forms, yet these forms
can be uploaded to DLI’s website and the license fee
paid electronically. Similarly, individual license exam
applicants will have to upload work experience verification
forms yet can pay exam and license fees electronically.
Once an individual has passed the license
exam, they can submit a license application and pay the
fees online, resulting in the immediate issuance of a license.

Plumbing Code
Possible model code adoption would
replace the State Plumbing Code
Changes to the Minnesota Plumbing Code, Chapter
4715, are being considered.
The Minnesota Plumbing Board is proposing to adopt
a national model code. The Request for Comments
about the proposed rules was published in the Nov. 13,
2012, edition of the State Register. The Plumbing Board
is requesting comments about the possibility of replacing
the Minnesota Plumbing Code with the 2012 Uniform
Plumbing Code (UPC) by reference, with
amendments.
All submitted written comments will be reviewed by the
Plumbing Board’s National Code Review Committee
and reported to the full board. The comment period will
end March 4, 2013.

Enforcement actions
Contractor fined $10,000 for unlicensed
activity
Some recent CCLD enforcement actions include:
• In October 2012, DLI revoked the license of a residential
building contractor who was found to
have submitted a license application that contained
false or misleading information. The contractor
was also fined $5,000.
• Also in October 2012, an unlicensed residential
building contractor from Golden valley was ordered
to cease and desist unlicensed activity and
fined $10,000. And another unlicensed contractor
from Winona was fined $7,000 and ordered to
cease and desist unlicensed activity.
• A St. Louis Park electrical contractor agreed to be
censured and to file all future requests for electrical
inspection electronically using CCLD’s
eTRAKiT system. The contractor was also fined
$5,000 with $4,500 of the fine stayed on the condition
of not future violations.

Online permit system saves
time for users and DLI
Since its launch in October, 2011, DLI’s online permit
system - eTRAKiT - has cut in half the amount of staff
time required to issue electrical permits and cut by 90
percent the time to process permits.
eTRAKiT, online at www.dli.mn.gov/CCLD
/etrakit.asp, enables electrical contractors and homeowners
to apply for permits, track current and historical
permits, review inspection results and pay fees - all in a
matter of minutes.
More recently, high-pressure-piping contractors have
also been able to apply for permits using eTRAKiT.
Before its launch, approval of electrial permits filed by
mail could take up to six weeks and the process was
staffed by seven workers. Today, paper permits average
a three-day turnaround - eTRAKiT permits are issued
instantly - with only three staff members only now overseeing
the approval of paper applications.
Since June 2012, nearly 70,000 electrical permits totaling
about 60 percent of all applications have been created
online using eTRAKiT. DLI averages about
100,000 requests for electrical permits each year.
“Providing Minnesotans with efficient electronic service
continues to be a top priority for our agency,” said
Ken Peterson, DLI commissioner.
With the success of using eTRAKiT to apply for electrical
permits, DLI is now working to implement the online
permit service for all construction codes and
licensing disciplines, such as building, elevators, mechanical
and plumbing.

MMBA MISSION STATEMENT
The Mid-Minnesota Builders Association (MMBA) of
Crow Wing, Wadena and lower Cass Counties,
fundamental purpose is to foster a healthy business
environment for the home building industry, and to
engage in activities that strengthen competitiveness,
professionalism, and the public's confidence in the
industry. The MMBA represents nearly 250 members,
involved in and supporting all phases of the home
building industry.
MMBA CODE OF ETHICS
Members of the Mid-Minnesota Builders
Association subscribe to the following Code
of Ethics:
• Members shall constantly seek to provide better
values for the customers they serve.
• Members shall at all times share their
knowledge with fellow members and the public
in the best interest of those they serve.
• Members shall not obtain any business by
means of fraudulent statements or by use of
implications unwarranted by fact or reasonable
probability.
• Members shall comply, both in spirit and letter,
