unto <strong>the</strong> said Donogh O Bryen and after his decease to Don<strong>at</strong> second Earl<br />

of <strong>Thomond</strong> son and heir of Donogh O Bryen as aforesaid through which<br />

means his posterity as tenant <strong>at</strong> will enjoyed <strong>the</strong> said land 3 ploughlands<br />

of Ballimcloone paying and being liable to such rent and impositions as<br />

was reserved upon <strong>the</strong>m by Don<strong>at</strong> second Earl of <strong>Thomond</strong>, Donogh Earl<br />

of <strong>Thomond</strong>, and Don<strong>at</strong> l<strong>at</strong>e Earl of <strong>Thomond</strong>. All which <strong>the</strong> rel<strong>at</strong>ions<br />

hereof will manifestly prove.<br />

As he saith th<strong>at</strong> Loughlen McCloone l<strong>at</strong>e of Cullinagh parcel of <strong>the</strong> said 3<br />

ploughland of Ballimacloone mortgaged a quartermeere of <strong>the</strong> said land<br />

unto Nicholas Strich l<strong>at</strong>e of Limerick which by <strong>the</strong> said Loughlen’s allowance<br />

redeemed by John McNemarra l<strong>at</strong>e of Dangenivigeene. The said<br />

Loughlen being sensible of his error in immortgage <strong>the</strong> land aforesaid<br />

without power or authority <strong>from</strong> <strong>the</strong> l<strong>at</strong>e Earl to whom <strong>the</strong> land properly<br />

belonged, submitted himself by petitioning unto <strong>the</strong> l<strong>at</strong>e Earl pretending<br />

th<strong>at</strong> mere necessity and poverty enforced him to immortgage <strong>the</strong> lands<br />

and in his supplic<strong>at</strong>ion requested th<strong>at</strong> <strong>the</strong> difference should referred to<br />

2 indifferent men to be composed which upon John McNemarra l<strong>at</strong>e of<br />

Danganbrack deceased and James McEnerhini were by uniform consent<br />

of <strong>the</strong> said l<strong>at</strong>e Earl and Loughlen elected for dividing th<strong>at</strong> difference; who<br />

made an order <strong>the</strong>rein which now remains in my Lord’s hands; wherein<br />

<strong>the</strong> circumstance of <strong>the</strong> m<strong>at</strong>ter contained.<br />

Rightful worshipful and much respected cousin, my silence th<strong>at</strong> hereunto<br />

proceeded not of fault of memory of <strong>the</strong> oblig<strong>at</strong>ion, and n<strong>at</strong>ural inclin<strong>at</strong>ion<br />

I owe to my deceased right honourable lords, your fa<strong>the</strong>r, and bro<strong>the</strong>r and<br />

to all your most noble ancestors, but ra<strong>the</strong>r th<strong>at</strong> I feared my service, and<br />

letters should not be acceptable to you, being absent for so many years and<br />

now with this peace between our king and <strong>the</strong>se parts, and understanding<br />

also by Mr James Aylmer, th<strong>at</strong> you will embrace my service, and letters,<br />

I make bold to offer you by those unadorned lines in English, in which I<br />

have but little skill, my humble duty and give notice how my kinsman in<br />

my absence, and without my consent as chief and supreme of <strong>the</strong>ir [sept]<br />

in Gleanomalun and o<strong>the</strong>r lands annexed, have passeth [sic] over <strong>the</strong>ir<br />

deeds indented to my most honourable Lord your fa<strong>the</strong>r for <strong>the</strong> half of <strong>the</strong><br />

said lands, and received an indenture under his honour’s hand, and seal,<br />

bearing d<strong>at</strong>e <strong>the</strong> 23 September 1606 to maintain <strong>the</strong>m quietly, and <strong>the</strong>ir<br />
