Flaring and Venting Nearshore Discharges EC Regulation No 1005/2009 on substances that deplete the ozone layer (as amended by EC Regulation No 744/2010) The Environmental Protection (Controls on Ozone Depleting Substances) Regulations 2002 (as amended 2008) Flyndre and Cawdor Environmental Statement Appendix A - Register of Environmental Legislation - EC Regulation 307/2008 The regulations now extend to carbon sequestration activities under the Energy Act 2008 (Consequential Modifications) (Offshore Environmental Protection) Order 2010. These regulations consolidate and replace EC Regulation 2037/2000 as amended by introducing tighter controls on the use/reuse of certain controlled substances. UK Statutory Instruments providing for EC Regulation 2037/2000 will continue to be in force until updated/amended for the new consolidated Regulation (see pending legislation). EC Regulation No 744/2010 extends the cut off date for the use of certain essential uses of halons in fire protection systems Regulator: DECC Model Clauses of Licences Regulator: DECC EC Directive 2000/60 (The Water Framework Directive) (as amended by EC Directive 2009/31) Implemented in England and Wales by: The Water Environment (Water Framework Directive) (England and Wales) Regulations The Environmental Protection (Controls on Ozone Depleting Substances) Regulations 2002 (as amended) make provision in the UK for EC Regulation 2037/2000 (as amended by Regulation no. 1005/2009 and 744/2010) and provide for a system of measures and penalties to control (amongst others) the emission of certain substances (in particular halons) that deplete the ozone layer. Controls the emissions from refrigeration systems, air‐conditioning units, fire‐protection systems and heat pumps. Requires operators to: Maintain annual records Check relevant equipment annually for leakages of ODS Monitor and annually report (by 31 March each year) data to EEMS on all emissions of halons, CFCs (if applicable) and HCFCs from relevant equipment. Due to the recent amendments to the EC regulations, further amendments to the UK legislation are required (see pending legislations). The Model clauses are incorporated into the Production Licences and require a flare and venting consent to be granted by DECC. Annual flare consents must be obtained from DECC. During commissioning and start up flare consents for short durations can be issued until flaring levels have stabilised. Flaring requirements must not exceed installations’ flare consent. Regulator: SEPA and EA The Water Framework Directive’s ultimate objective is to achieve “good ecological and chemical status” for all Community waters by 2015. Flyndre and Cawdor Environmental Statement Appendix A - Register of Environmental Legislation Sewage from installations Waste 2003 The Water Resources Act 1990 (superseded by the Water Resources Act 1991) Implemented in Scotland by: Water Environment and Water Services (Scotland) Act 2003 the Water Environment (Controlled Activities) (Scotland) Regulations 2011 Food and Environment Protection Act 1985 (as amended) Deposits in the Sea (Exemptions) Order 1985 the Deposits in the Sea (Exemptions) (Amended) (England and Wales) Order 2010 (extends to England and Wales only) EC Directive 2006/12 (EU Waste Framework Directive) (repealed by EC Directive 2008/98) ( as amended by EC Directive 2009/31 improving aquatic ecosystems. In the UK, discharges to controlled waters need consent from either SEPA or EA. The discharge of waste to coastal waters or estuaries is controlled by these regulations and requires consent obtainable from either SEPA or EA. The consent will have conditions associated with it, including volume, rate of discharge and concentrations of specified substances. The Water Environment (Controlled Activities) (Scotland) Regulations 2011 came into force on 31 st March 2011 and consolidate the Water Environment (Controlled Activities) Regulations 2005 and the Water Environment (Controlled Activities) (Scotland) Amendment Regulations 2007. Regulator: DECC supported by CEFAS and Marine Scotland Discharges of sewage, and grey and black water as part of routine operations are permitted discharges under the Deposits in the Sea (Exemptions) Order 1985. Deposits in the Sea (Exemptions) (Amendment) (England and Wales) Order 2010 came into force in April 2010 in England and Wales only, making minor amendments to the Deposits in the Sea (Exemption) Order 1985, however, the above still applies. The Waste Framework Directive establishes a legal framework for the treatment of waste in the EU. It aims at protecting the environment and human health through the prevention of the harmful effects of waste generation and waste management. It does not apply to the following (which are captured under various other regulations discussed): gaseous effluents radioactive elements decommissioned explosives faecal matter waste waters animal by‐products carcasses of animals that have died not from being slaughtered elements resulting from mineral resources National Waste Strategy Commits the UK to a target of cutting landfill of biodegradable waste by two thirds by 2020. MARPOL Annex V: Prevention of pollution by garbage from ships The Merchant Shipping (Prevention of Pollution by Sewage and Garbage from Ships) Regulations 2008 (as amended 2010) Regulator: Maritime and Coastguard Agency There have been significant amendments to Annex V of MARPOL since it first entered into force in 1998. The Merchant Shipping (Prevention of Pollution by Sewage and Garbage from Ships) Regulations 2008 (as amended) supersede Merchant Shipping (Prevention of Pollution by Garbage from Ships) Regulations 1998 and bring the previous implementing regulations into line with the current version of Annex V.
