Nanotechnology: A <strong>Risk</strong>y<br />

Business?<br />

Much has been made in recent years of the<br />

potential for nanotechnologies <str<strong>on</strong>g>to</str<strong>on</strong>g> solve almost<br />

every human c<strong>on</strong>diti<strong>on</strong>, <str<strong>on</strong>g>to</str<strong>on</strong>g> provide<br />

soluti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> almost every global problem,<br />

while also becoming a multi trilli<strong>on</strong> dollar<br />

market. His<str<strong>on</strong>g>to</str<strong>on</strong>g>ry has shown that many technologies<br />

should be regarded as doubleedged<br />

swords, <strong>and</strong> in recent years the potential<br />

downside of nanotechnology has<br />

been attracting almost as much attenti<strong>on</strong><br />

as the potential benefits.<br />

Of particular interest <str<strong>on</strong>g>to</str<strong>on</strong>g> industry are the<br />

twin issues of risk <strong>and</strong> regulati<strong>on</strong>. Insurance<br />

companies, led in 2003 by Munich<br />

Re 1 , then followed by Swiss Re 2 (2004)<br />

<strong>and</strong> Allianz 3 (2005) have been taking closer<br />

looks at the risks associated with nanotechnologies,<br />

while governments, from the<br />

European Parliament <str<strong>on</strong>g>to</str<strong>on</strong>g> nati<strong>on</strong>al bodies<br />

have been facing calls from Princes <strong>and</strong><br />

pressure groups 4 <str<strong>on</strong>g>to</str<strong>on</strong>g> take a closer look at<br />

nanotechnologies. As a result, a large<br />

number of column inches have been dedicated<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the risks of nanotechnologies,<br />

whether real or perceived.<br />

Perceived risks, such as those created<br />

through a belief in hyperbole or as a result<br />

of attempts by activists <str<strong>on</strong>g>to</str<strong>on</strong>g> link nano <strong>and</strong><br />

biotechnologies, although without substance,<br />

can affect c<strong>on</strong>sumer behavior <strong>and</strong><br />

hence impact business. Such risks how-<br />

ever are unlikely <str<strong>on</strong>g>to</str<strong>on</strong>g> result in either class<br />

acti<strong>on</strong> suits or legislati<strong>on</strong>. Of more c<strong>on</strong>cern<br />

are the real risks, which are generated by<br />

the c<strong>on</strong>sequences of the interacti<strong>on</strong> between<br />

the new classes of nanomaterials<br />

being produced <strong>and</strong> the human body or<br />

envir<strong>on</strong>ment.<br />

These risks <strong>and</strong> their corresp<strong>on</strong>ding uncertainties<br />

are the subject of this report.<br />

The c<strong>on</strong>sequences of risk <strong>and</strong> regulati<strong>on</strong><br />

can be immense. The three waves of asbes<str<strong>on</strong>g>to</str<strong>on</strong>g>s<br />

claims so far have cost US insurers<br />

<strong>and</strong> re-insurers approximately $135 billi<strong>on</strong><br />

<strong>and</strong> estimates for the fourth are as high are<br />

as high as additi<strong>on</strong>al 200 <str<strong>on</strong>g>to</str<strong>on</strong>g> $275 billi<strong>on</strong> 5 ,<br />

while the European Commissi<strong>on</strong>s REACH<br />

proposals may cost European industry<br />

some 1.4-12,8 billi<strong>on</strong> euros. 6<br />

Downstream liabilities are not limited <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

harmful effects of the materials used, but<br />

also in their disposal. Products from au<str<strong>on</strong>g>to</str<strong>on</strong>g>mobiles<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> refrigera<str<strong>on</strong>g>to</str<strong>on</strong>g>rs have been subjected<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> retrospective legislati<strong>on</strong> covering<br />

their disposal, with the cost burden falling<br />

both <strong>on</strong> the c<strong>on</strong>sumers <strong>and</strong> producers. In<br />

extreme cases, such as that of the nuclear<br />

power industry, shifting the financial burden<br />

for decommissi<strong>on</strong>ing from government <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

the opera<str<strong>on</strong>g>to</str<strong>on</strong>g>rs has changed the entire ec<strong>on</strong>omics<br />

of the industry in some parts of the<br />

world.<br />

As is all <str<strong>on</strong>g>to</str<strong>on</strong>g>o often the case with nanotechnologies,<br />

the breadth <strong>and</strong> complexity of the<br />

field has baffled policy makers, actuaries,<br />

patent at<str<strong>on</strong>g>to</str<strong>on</strong>g>rneys <strong>and</strong> inves<str<strong>on</strong>g>to</str<strong>on</strong>g>rs leading <str<strong>on</strong>g>to</str<strong>on</strong>g> a<br />

highly c<strong>on</strong>fused situati<strong>on</strong>.<br />

While policy makers may attempt <str<strong>on</strong>g>to</str<strong>on</strong>g> grapple<br />

with the whole of nanotechnology, most<br />

businesses are applying <strong>on</strong>ly a limited<br />

number of nanotechnologies <str<strong>on</strong>g>to</str<strong>on</strong>g> their products,<br />

allowing a sharper focus <strong>on</strong> both the<br />

risks <strong>and</strong> benefits.<br />

Companies around the globe are beginning<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> mass-produce nano-particles for use in<br />

everything from sunscreens <str<strong>on</strong>g>to</str<strong>on</strong>g> soil reclamati<strong>on</strong>.<br />

An analysis of the global media in<br />

the year <str<strong>on</strong>g>to</str<strong>on</strong>g> May 2005 shows that almost<br />

half of all men<str<strong>on</strong>g>ti<strong>on</strong>ed</str<strong>on</strong>g> products are nanomaterials<br />

related. The producti<strong>on</strong> of anthropogenically<br />

7 derived nanoparticles will<br />

inevitably result in the introducti<strong>on</strong> of these<br />

materials <str<strong>on</strong>g>to</str<strong>on</strong>g> the envir<strong>on</strong>ment, whether de-<br />

Unless policy makers adopt a similarly narrow<br />

focus, based <strong>on</strong> the applicati<strong>on</strong>s rather<br />

than the technologies, then businesses applying<br />

unrelated nanomaterials run the risk<br />

of significant changes <str<strong>on</strong>g>to</str<strong>on</strong>g> their business<br />

models as a result of legislati<strong>on</strong>.<br />

liberately, or through careless disposal of<br />

materials, industrial accidents, or simply as<br />

a result of abrasi<strong>on</strong> <strong>and</strong> aging of the materials<br />

in which the nanomaterials are bound,<br />

whether an au<str<strong>on</strong>g>to</str<strong>on</strong>g>mobile tyre, food packaging<br />

or a textile fiber.<br />

Despite rapid advances in the producti<strong>on</strong><br />

<strong>and</strong> characterizati<strong>on</strong> of nanotechnologies,<br />

current knowledge of the potential risks of<br />

nanoparticles <str<strong>on</strong>g>to</str<strong>on</strong>g> human health <strong>and</strong> the envir<strong>on</strong>ment<br />

is limited. While many of the<br />

properties of nanomaterials, whether<br />

chemical or optical are highly size dependent,<br />

there is a c<strong>on</strong>cern that size also matters<br />

with respect <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>to</str<strong>on</strong>g>xicity, irrespective of<br />

the chemical compositi<strong>on</strong> <strong>and</strong> that some<br />

materials that are biologically inert in bulk<br />

may tend <str<strong>on</strong>g>to</str<strong>on</strong>g> become harmful in ultrafine<br />

particle form.<br />

A further cause for c<strong>on</strong>cern is that observed<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g>xicological resp<strong>on</strong>ses in cell cultures<br />

<strong>and</strong> animals may also be dependent<br />

up<strong>on</strong> available surface area. Many of the<br />

proposed applicati<strong>on</strong>s of nanomaterials,<br />

from carb<strong>on</strong> nanotubes <str<strong>on</strong>g>to</str<strong>on</strong>g> metal oxide<br />

nanoparticles, <strong>and</strong> from filtrati<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> catalysis,<br />

take advantage of their high surface<br />

area.<br />

Finally, there are also indicati<strong>on</strong>s that<br />

ultrafine particles can penetrate through<br />

the skin, or translocate from the respira<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

system <str<strong>on</strong>g>to</str<strong>on</strong>g> other organs.<br />

This is a rapidly evolving field of research<br />

with new, <strong>and</strong> often c<strong>on</strong>tradic<str<strong>on</strong>g>to</str<strong>on</strong>g>ry findings<br />

emerging <strong>on</strong> a weekly basis. The fact that<br />

fifteen years after the discovery of carb<strong>on</strong><br />

nanotubes, scientists are still finding new<br />

properties of this class of materials indicates<br />

how little knowledge exists of the<br />

physical, let al<strong>on</strong>e the <str<strong>on</strong>g>to</str<strong>on</strong>g>xicological properties.<br />

<strong>Risk</strong>s versus Hazard<br />

A popular, <strong>and</strong> incorrect argument often<br />

heard is that if some nanomaterials are<br />

potentially harmful then a mora<str<strong>on</strong>g>to</str<strong>on</strong>g>rium<br />

should be declared <strong>on</strong> their producti<strong>on</strong>, often<br />

invoking the precauti<strong>on</strong>ary principle.<br />

However it must be remembered that hazards<br />

are an intrinsic property of a material,<br />

whereas risks can be managed <strong>and</strong> minimized.<br />

Important Distincti<strong>on</strong>s<br />

Hazard - the potential <str<strong>on</strong>g>to</str<strong>on</strong>g> cause<br />

harm.<br />

Exposure – the c<strong>on</strong>centrati<strong>on</strong> of<br />

a substance in the medium multiplied<br />

by the durati<strong>on</strong> of c<strong>on</strong>tact.<br />

Dose – the amount of a substance<br />

that will reach a specific<br />

biological system.<br />

<strong>Risk</strong> – the likelihood of harm<br />

occurring.<br />

As an example, a glass tumbler filled with<br />

acid, a hazardous substance, <strong>and</strong> left unattended<br />

poses a severe risk, whereas if<br />

that same hazardous substance is put in a<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>ppered bottle clearly marked !DANGER:<br />

ACID", <strong>and</strong> placed in a cupboard in a labora<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

where access is restricted <str<strong>on</strong>g>to</str<strong>on</strong>g> those<br />

who have underg<strong>on</strong>e training in h<strong>and</strong>ling<br />

the acid then the risk is minimized, while<br />

the hazard remains.<br />

Once a hazard has been established, there<br />

are a number of strategies for minimizing<br />

risk as summarized in the text box below.<br />

Care with disposal<br />

The first major challenge in minimizing<br />

risks of nanomaterials is therefore in<br />

knowing what label <str<strong>on</strong>g>to</str<strong>on</strong>g> put <strong>on</strong> the bottle, i.e<br />

determining whether a hazard exists. If<br />

carb<strong>on</strong> nanotubes are shipped with materials<br />

h<strong>and</strong>ing instructi<strong>on</strong>s for activated char-<br />

coal, as has occurred in the past, then the<br />

risk of exposure is far higher than if they<br />

are clearly <strong>and</strong> appropriately labeled. Fortunately<br />

current industrial health <strong>and</strong> safety<br />

best practices dictate that all new materials<br />

are assumed harmful unless there is firm<br />

evidence <str<strong>on</strong>g>to</str<strong>on</strong>g> the c<strong>on</strong>trary. While the reas<strong>on</strong>s<br />

for this may be obvious in many cases, for<br />

example in the pharmaceutical industry,<br />

where the c<strong>on</strong>sequences can be potential<br />

fatal, this may not be the case in a university<br />

labora<str<strong>on</strong>g>to</str<strong>on</strong>g>ry where researchers are experimenting<br />

with the growth of fullerenes.<br />

It should be noted that in the producti<strong>on</strong> of<br />

many nanomaterials much of the effort<br />

goes not in<str<strong>on</strong>g>to</str<strong>on</strong>g> producing the materials but<br />

keeping them subsequently dispersed.<br />

Small particles are by nature highly reactive<br />

as almost all of the a<str<strong>on</strong>g>to</str<strong>on</strong>g>ms in the particle<br />

sit at the surface where they are available<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> take part in reacti<strong>on</strong>s, rather than<br />

being buried deep in the core, <strong>and</strong> therefore<br />

tend <str<strong>on</strong>g>to</str<strong>on</strong>g> clump <str<strong>on</strong>g>to</str<strong>on</strong>g>gether given the<br />

chance, reducing their effectiveness. On<br />

the other h<strong>and</strong>, the tendency of nanomaterials<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> agglomerate reduces somewhat the<br />

likelihood of an accidental release causing<br />

widespread c<strong>on</strong>taminati<strong>on</strong>.<br />

However the recent UK Royal Society report<br />

8 was till sufficiently worried <str<strong>on</strong>g>to</str<strong>on</strong>g> recommend<br />

“that the use of free (that is, not fixed<br />

in a matrix) manufactured nanoparticles in<br />

envir<strong>on</strong>mental applicati<strong>on</strong>s such as remediati<strong>on</strong><br />

be prohibited until appropriate research<br />

has been undertaken <strong>and</strong> it can be<br />

dem<strong>on</strong>strated that the potential benefits<br />

outweigh the potential risks.”<br />

Measuring <strong>Risk</strong><br />

The first challenge in establishing the level<br />

of risk associated with a nanomaterial is in<br />

detecting the presence of the material. This<br />

is an area that has <strong>on</strong>ly recently begun <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

be addressed, <strong>and</strong> as a result of c<strong>on</strong>cerns<br />

over the health <strong>and</strong> envir<strong>on</strong>mental effects<br />

of nanoparticles, it has been established<br />

that major current sources are emissi<strong>on</strong>s<br />

from vehicles 9 , welding <strong>and</strong> smelting 10<br />

rather than companies producing nanomaterials.<br />

While many <str<strong>on</strong>g>to</str<strong>on</strong>g>ols exist for measuring particle<br />

c<strong>on</strong>centrati<strong>on</strong>s, these suffer from two<br />

major drawbacks.<br />

Firstly many high throughput particle<br />

counting technologies such as those using<br />

dynamic light scattering simply give a<br />

mean particle size allowing the presence of<br />

high c<strong>on</strong>centrati<strong>on</strong>s of small particles <str<strong>on</strong>g>to</str<strong>on</strong>g> be<br />

masked by lower numbers of much larger<br />

particles. While these techniques may be<br />

appropriate for m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring particles in c<strong>on</strong>trolled<br />

envir<strong>on</strong>ments, the real world provides<br />

a more challenging dynamic mixture<br />

of particle types, varying in size both with<br />

locati<strong>on</strong> <strong>and</strong> time. The natural tendency of<br />

nanoparticles <str<strong>on</strong>g>to</str<strong>on</strong>g> agglomerate means that<br />

the size distributi<strong>on</strong> of released particles<br />

shifts upwards with time, meaning that the<br />

risk from freshly produced materials may<br />

be several times higher than that from<br />

s<str<strong>on</strong>g>to</str<strong>on</strong>g>red materials.<br />

A sec<strong>on</strong>d group of particle detecti<strong>on</strong> technologies<br />

rely <strong>on</strong> capturing particles from<br />

the envir<strong>on</strong>ment, <strong>on</strong> using either a filter or<br />

an adhesive surface, <strong>and</strong> physically imaging<br />

the particles <strong>and</strong> counting them individually<br />

using an electr<strong>on</strong> microscope.<br />

While this gives a more accurate size distributi<strong>on</strong>,<br />

the technique suffers from low<br />

throughput due <str<strong>on</strong>g>to</str<strong>on</strong>g> both the turnaround time<br />

associated with the introducti<strong>on</strong> of samples<br />

in<str<strong>on</strong>g>to</str<strong>on</strong>g> the instrument, <strong>and</strong> the instrument size<br />

<strong>and</strong> complexity making in situ analysis unfeasible<br />

outside the microscopy lab.<br />

Soluti<strong>on</strong>s <str<strong>on</strong>g>to</str<strong>on</strong>g> the problem of detecti<strong>on</strong> are<br />

being developed, <strong>and</strong> range from !optical<br />

nanoscopy 11 " <str<strong>on</strong>g>to</str<strong>on</strong>g> video rate a<str<strong>on</strong>g>to</str<strong>on</strong>g>mic force microscopy<br />

12 . However not every technique<br />

will be appropriate <str<strong>on</strong>g>to</str<strong>on</strong>g> all situati<strong>on</strong>s (airborne<br />

particles, surface c<strong>on</strong>taminati<strong>on</strong>,<br />

particles in suspensi<strong>on</strong>) <strong>and</strong> care must be<br />

taken in choosing the appropriate m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>r-<br />

ing technologies.<br />

In the meantime it is not unreas<strong>on</strong>able <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

assume that exposure <str<strong>on</strong>g>to</str<strong>on</strong>g> potentially harmful<br />

nanomaterials has already occurred in<br />

both academic <strong>and</strong> producti<strong>on</strong> facilities.<br />

Many academic establishments <strong>and</strong> companies<br />

do not yet have adequate procedures<br />

for m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>ring exposure <str<strong>on</strong>g>to</str<strong>on</strong>g> nanomaterials.<br />

As a result of this uncertainty, <strong>on</strong>e<br />

company specializing in refurbishing clean<br />

rooms has recently seen dramatic increases<br />

in its insurance premiums.<br />

<strong>Risk</strong>s of the Regulati<strong>on</strong> of<br />

Nanoparticles<br />

N<strong>on</strong>e of the discussi<strong>on</strong> over the safety of<br />

nanomaterials has escaped the attenti<strong>on</strong> of<br />

those resp<strong>on</strong>sible for regulati<strong>on</strong>. The European<br />

Commissi<strong>on</strong> has already held a number<br />

of workshops examining the need for<br />

regulati<strong>on</strong>, <strong>and</strong> the European Parliament<br />

held a workshop in February 2004 titles<br />

"Precauti<strong>on</strong>ary Principle <strong>and</strong> Nanotechnology"<br />

13 c<strong>on</strong>cluding that "the Precauti<strong>on</strong>ary<br />

Principle of the European Uni<strong>on</strong> points out<br />

the scientific uncertainty is no reas<strong>on</strong> for<br />

inacti<strong>on</strong> if there might be immense adverse<br />

effects. If there is a decisi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> act there<br />

still remains a variety of potential acti<strong>on</strong>s.<br />

Ranging from a ban <str<strong>on</strong>g>to</str<strong>on</strong>g> further research<br />

projects as well as recommendati<strong>on</strong>s.<br />

Therewith, the questi<strong>on</strong> might be raised<br />

how <str<strong>on</strong>g>to</str<strong>on</strong>g> act c<strong>on</strong>cerning nanotechnologies."<br />

On the other h<strong>and</strong> the European Commissi<strong>on</strong>"s<br />

workshop “Research Needs <strong>on</strong><br />

Nanoparticles” 14 c<strong>on</strong>cluded that “No unc<strong>on</strong>trollable<br />

nano-specific risks have<br />

emerged <str<strong>on</strong>g>to</str<strong>on</strong>g>-date, but extensive research<br />

should be carried out in a timely manner in<br />

order <str<strong>on</strong>g>to</str<strong>on</strong>g> accompany the technological development<br />

<strong>and</strong> producti<strong>on</strong> of nanoparticles<br />

with appropriate (eco)<str<strong>on</strong>g>to</str<strong>on</strong>g>xicological data<br />

<strong>and</strong> exposure so <str<strong>on</strong>g>to</str<strong>on</strong>g> pave the way -where<br />

the case- <str<strong>on</strong>g>to</str<strong>on</strong>g> specific new regulati<strong>on</strong>.”<br />

Both these c<strong>on</strong>clusi<strong>on</strong>s have been noted<br />

by both regula<str<strong>on</strong>g>to</str<strong>on</strong>g>rs <strong>and</strong> insurance companies,<br />

but the lack of even a comm<strong>on</strong>ly accepted<br />

definiti<strong>on</strong> of a nanoparticle is holding<br />

back progress. A recent publicati<strong>on</strong><br />

from British St<strong>and</strong>ards 15 goes some way <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

addressing this issue, but progress in internati<strong>on</strong>al<br />

st<strong>and</strong>ards is always slow.<br />

The Precauti<strong>on</strong>ary principle<br />

"When an activity raises threats of<br />

harm <str<strong>on</strong>g>to</str<strong>on</strong>g> human health or the envir<strong>on</strong>ment,<br />

precauti<strong>on</strong>ary measures<br />

should be taken even if some cause<br />

<strong>and</strong> effect relati<strong>on</strong>ships are not fully<br />

established scientifically. In this c<strong>on</strong>text<br />

the prop<strong>on</strong>ent of an activity,<br />

rather than the public, should bear<br />

the burden of proof. The process of<br />

applying the precauti<strong>on</strong>ary principle<br />

must be open, informed <strong>and</strong> democratic<br />

<strong>and</strong> must include potentially<br />

affected parties. It must also involve<br />

an examinati<strong>on</strong> of the full range of<br />

alternatives, including no acti<strong>on</strong>."<br />

As a result, companies are currently exposed<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> both the risk of unfavorable leg-<br />

islati<strong>on</strong> making major changes <str<strong>on</strong>g>to</str<strong>on</strong>g> their<br />

business models, <strong>and</strong> the risk of currently<br />

used materials being later shown <str<strong>on</strong>g>to</str<strong>on</strong>g> be<br />

more hazardous than previously thought.<br />

A major risk <str<strong>on</strong>g>to</str<strong>on</strong>g> business is that of hasty or<br />

poorly thought out legislati<strong>on</strong>. While regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

bodies from Europe <str<strong>on</strong>g>to</str<strong>on</strong>g> Japan are<br />

currently waiting for some c<strong>on</strong>clusive results<br />

before acting, a single industrial accident<br />

involving nanoparticles could precipitate<br />

a knee-jerk reacti<strong>on</strong>, covering not just<br />

the material in questi<strong>on</strong>, but perhaps the<br />

whole field of nanotechnology.<br />

The same will be true of public percepti<strong>on</strong><br />

of nanotechnologies, requiring substantial<br />

changes of approach by any companies<br />

involved in the producti<strong>on</strong> or applicati<strong>on</strong> of<br />

nanomaterials. As a first step in res<str<strong>on</strong>g>to</str<strong>on</strong>g>ring<br />

public c<strong>on</strong>fidence, companies will need <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

be clear about the risks associated with<br />

their products, <strong>and</strong> the steps they have<br />

taken <str<strong>on</strong>g>to</str<strong>on</strong>g> minimize these. The experience of<br />

GMOs in Europe illustrates clearly that if<br />

companies do not have immediate access<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> informati<strong>on</strong> about health, safety <strong>and</strong> envir<strong>on</strong>mental<br />

impact of technologies, the<br />

public, <strong>and</strong> regula<str<strong>on</strong>g>to</str<strong>on</strong>g>rs, will always take the<br />

most cautious approach <strong>and</strong> invoke the<br />

precauti<strong>on</strong>ary principle.<br />

Current thinking am<strong>on</strong>g regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry bodies<br />

falls in<str<strong>on</strong>g>to</str<strong>on</strong>g> three broad areas:<br />

Regulati<strong>on</strong> of !nanotechnology"<br />

Regulati<strong>on</strong> of applicati<strong>on</strong>s of nanotechnologies<br />

No new regulati<strong>on</strong>.<br />

While much was heard about general<br />

regulati<strong>on</strong> in 2003 <strong>and</strong> 2004, it is now becoming<br />

more accepted by policy makers<br />

that attempting <str<strong>on</strong>g>to</str<strong>on</strong>g> regulate !nanotechnol-<br />

ogy" would be akin <str<strong>on</strong>g>to</str<strong>on</strong>g> regulating !chemistry"<br />

or !electr<strong>on</strong>ics." As a result, focus is shifting<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> regulati<strong>on</strong> of the applicati<strong>on</strong>s of nanotechnologies,<br />

<strong>and</strong> c<strong>on</strong>sidering whether the<br />

existing regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry framework, for example<br />

for medical devices, takes in<str<strong>on</strong>g>to</str<strong>on</strong>g> account the<br />

novel properties brought about by the use<br />

of nanotechnologies.<br />

The current view, as reflected in the UKs<br />

Royal Society Report is that no new regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry<br />

bodies are needed, <strong>and</strong> that existing<br />

regula<str<strong>on</strong>g>to</str<strong>on</strong>g>ry frameworks should be reevaluated<br />

in the light of these new materials.<br />

A L<strong>on</strong>g Term Problem?<br />

While much of the current debate focuses<br />

<strong>on</strong> the producti<strong>on</strong> of nanomaterials, l<strong>on</strong>gerterm<br />

issues also need <str<strong>on</strong>g>to</str<strong>on</strong>g> be c<strong>on</strong>sidered.<br />

While many nanomaterials are currently<br />

being incorporated in<str<strong>on</strong>g>to</str<strong>on</strong>g> other materials,<br />

such as polymers <strong>and</strong> coatings, thus reducing<br />

the risk, the issue of product life cycle<br />

remains <str<strong>on</strong>g>to</str<strong>on</strong>g> be addressed. Regula<str<strong>on</strong>g>to</str<strong>on</strong>g>rs<br />

are already asking questi<strong>on</strong>s about what<br />

happens <str<strong>on</strong>g>to</str<strong>on</strong>g> nanomaterials when products<br />

in which they are used come <str<strong>on</strong>g>to</str<strong>on</strong>g> the end of<br />

their lifetimes. Many questi<strong>on</strong>s remain <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

be answered such as:<br />

What happens after the disposal of<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g>iletries <strong>and</strong> cosmetics c<strong>on</strong>taining<br />

nanomaterials?<br />

What are the effects of dumping c<strong>on</strong>sumer<br />

goods c<strong>on</strong>taining nanomaterials<br />

in l<strong>and</strong>fills or incinerating them?<br />

Are there risks associated with exposure<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> the combusti<strong>on</strong> of products<br />

c<strong>on</strong>taining nanomaterials whether deliberate<br />

or accidental?<br />

While the disposal of large objects such as<br />

as household appliances <strong>and</strong> au<str<strong>on</strong>g>to</str<strong>on</strong>g>mobiles<br />

can, <str<strong>on</strong>g>to</str<strong>on</strong>g> a large extent, be c<strong>on</strong>trolled <strong>and</strong><br />

m<strong>on</strong>i<str<strong>on</strong>g>to</str<strong>on</strong>g>red, significant questi<strong>on</strong>s remain<br />

over the applicati<strong>on</strong> of nanomaterials <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

high volume applicati<strong>on</strong>s such as paper<br />

<strong>and</strong> packaging. The polluti<strong>on</strong> caused by the<br />

unc<strong>on</strong>trolled release of plastics in<str<strong>on</strong>g>to</str<strong>on</strong>g> the envir<strong>on</strong>ment<br />

(whether carrier bags in southern<br />

India or in<str<strong>on</strong>g>to</str<strong>on</strong>g> the marine envir<strong>on</strong>ment<br />

where plastics make up 60 <str<strong>on</strong>g>to</str<strong>on</strong>g> 80% of <str<strong>on</strong>g>to</str<strong>on</strong>g>tal<br />

marine debris) illustrates the ease with<br />

which materials can become widely dispersed<br />

over large areas.<br />

<strong>Risk</strong> Management Soluti<strong>on</strong>s<br />

Currently, any<strong>on</strong>e producing or using<br />

nanomaterials is at the mercy of both insurers<br />

<strong>and</strong> regula<str<strong>on</strong>g>to</str<strong>on</strong>g>rs. Nobody wants <str<strong>on</strong>g>to</str<strong>on</strong>g> be<br />

<strong>on</strong> the receiving end of a class acti<strong>on</strong> suit<br />

in five, ten or twenty years time. With proposals<br />

<strong>on</strong> the table for full lifetime testing of<br />

nanomaterials, <strong>and</strong> current legislati<strong>on</strong> impacting<br />

even the disposal of goods from<br />

au<str<strong>on</strong>g>to</str<strong>on</strong>g>mobiles <str<strong>on</strong>g>to</str<strong>on</strong>g> refrigera<str<strong>on</strong>g>to</str<strong>on</strong>g>rs with manufactures<br />

shouldering the burden, industry<br />

needs solid, reliable informati<strong>on</strong> about the<br />

directi<strong>on</strong> legislati<strong>on</strong> will take. A delegate<br />

from a major internati<strong>on</strong>al au<str<strong>on</strong>g>to</str<strong>on</strong>g>motive<br />

manufacturer was shocked <str<strong>on</strong>g>to</str<strong>on</strong>g> hear at a<br />

recent c<strong>on</strong>ference that there may be health<br />

<strong>and</strong> safety c<strong>on</strong>siderati<strong>on</strong>s related <str<strong>on</strong>g>to</str<strong>on</strong>g> some<br />

of the materials already in use.<br />

The dilemma is that while <str<strong>on</strong>g>to</str<strong>on</strong>g>xicological<br />

studies can take up <str<strong>on</strong>g>to</str<strong>on</strong>g> ten years, corporati<strong>on</strong>s<br />

are under pressure <str<strong>on</strong>g>to</str<strong>on</strong>g> deliver shareholder<br />

value <str<strong>on</strong>g>to</str<strong>on</strong>g>day. The soluti<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> this<br />

problem lies in the availability of high quality<br />

informati<strong>on</strong>, both <strong>on</strong> the possible health<br />

<strong>and</strong> envir<strong>on</strong>mental effects, as well as current<br />

thinking in Brussels, Washing<str<strong>on</strong>g>to</str<strong>on</strong>g>n DC<br />

<strong>and</strong> Tokyo.<br />

While no-<strong>on</strong>e can predict the future, <str<strong>on</strong>g>Cientifica</str<strong>on</strong>g><br />
