badly injured near Maseno Hospital. At the time <strong>of</strong> the sub-division made to create Vihiga District from Kakamega, a proper<br />

Boundary was drawn in 1986-87 which has not been recognised. We wish this Constitutional review to see to it that this<br />

boundary is recognised. And Emuhaya constituency to be added two additional seats plus the Division <strong>of</strong> Maseno which should<br />

be transferred to Vihiga District.<br />

Position <strong>of</strong> President and Vice President... First <strong>of</strong> all before I come to that, I think counting <strong>of</strong> votes, during any election should<br />

be carried out at the polling station and not any other place.<br />

Position <strong>of</strong> the President and the Vice President: The Constitution should provide for nomination <strong>of</strong> the presidential candidate by<br />

political parties, to be enjoined with that <strong>of</strong> a running mate. Both <strong>of</strong> whom must be subject to the popular vote <strong>of</strong> the electorate.<br />

They should not participate in or represent a particular or specific constituency. Besides being a proper manner to guarantee<br />

equal and effective representation at grassroot level, this method will always limit the number <strong>of</strong> aspirants for President to only<br />

two or three since very few people will wish to or loose their chance to contest election at the constituency level.<br />

The position <strong>of</strong> Prime Minister should not be created. And the President should only have the power to nominate or appoint<br />

ministers according to the ministries that there are. And not any more than it is necessary. Instead <strong>of</strong> having assistant ministers,<br />

we should have deputy ministers who should actually deputise for their ministers in their absence <strong>of</strong> performance.<br />

The Electoral Commission should be empowered to get into and resolve the complaints during elections. And they should be<br />

able to discipline Members <strong>of</strong> the waring candidates and even the candidates themselves to be disqualified if their suporters<br />

intimidate other people and cause violence.<br />

To the cabinet and ministers, there is a very serious overlapping <strong>of</strong> duties and responsibilities due to carefree uncontrolled<br />

creation and establishment <strong>of</strong> some obviously unnecessary ministries. The Constitution should state the number <strong>of</strong> ministers<br />

determined and shall constitute a responsible cabinet and down the line create an efficient civil service. Abolish <strong>of</strong>fice <strong>of</strong> the<br />

President as a specific ministry and adjust and establish only eighteen ministries.<br />

Before I finish, I think the universities should be independent institutions to promote educational policy <strong>of</strong> the government. The<br />

government should not be responsible for appointing chancellors and vice chancellors, these people should be promoted<br />

according to their qualification and experience.<br />

Corruption is rampant in the country mainly because, civil servants engage in private business. For instance, doctors running<br />

clinics and so on and so on. I think to eradicate these problem, the Ndegwa recommendation should be legally abolished and<br />

Members <strong>of</strong> Parliament must not be allowed to engage in business either. For instance a Member <strong>of</strong> Parliament who is a<br />
