not been recognised since independence. Therefore there is an urgent need for a political boundary review. Now the<br />

demarcation <strong>of</strong> the constituency and wards are not satisfactory. Therefore, population census should be considered such that<br />

elected leaders have almost equal representation in terms <strong>of</strong> votes cast. For example, Luanda division in Emuhaya constituency<br />

population wise is bigger than Vihiga constituency in Vihiga district, hence the need to split Emuhaya constituency into two or<br />

even three constituencies.<br />

Then, we are <strong>of</strong> the opinion that the holding <strong>of</strong> civic, Parliamentary and presidential election should be separated such that<br />

presidential elections come first. We also suggest that election date be specified in the Constitution and not left as a weapon for<br />

the Executive. We are also <strong>of</strong> the opinion that the 22 Electoral Commissioners whose function is to conduct elections and<br />

by-elections, their qualifications should such that they be <strong>of</strong> 0-level and above, and these Commissioners can be removed from<br />

the <strong>of</strong>fice in case <strong>of</strong> incapacitation or end <strong>of</strong> tenure <strong>of</strong> <strong>of</strong>fice or incompetency or breach <strong>of</strong> contract. The rest,because <strong>of</strong> time, I<br />

Reboam Mutsili: My names are Reboam Mutsili. I have a few observations to make.<br />

First, our new Constitution should state clearly how many ministries we should have in Kenya. If they are 17, they should be 17<br />

and each ministry should be manned by one Minister and two deputy ministers. I see no point <strong>of</strong> us having two ministers or<br />

three ministers in one ministry like energy and health. So the point <strong>of</strong> having one Minister and two deputies will be convinient in<br />

our new Constitution.<br />

Second one is that we should have six registered political parties in our Constitution. I mean the Constituion state clearly that…<br />

NB: No proper connection from side A to side B.<br />

…in their payments when the working civil servants are being considered for review <strong>of</strong> their salary. That is my last point.<br />

Com. Nunow: I would like to ask you whether you thought through how the current number <strong>of</strong> political parties that are 48 or<br />

47 can be reduced to the proposed number <strong>of</strong> six. If you haven’t thought about it you don’t have to anwer, that is a task for the<br />

Commission But if you thought about it, it could assist us if you mentioned what you think in your opinion could be the<br />

modalities <strong>of</strong> reducing that number.<br />
