A BILL
To correct inconsistencies in the definitions affecting Native Americans under the Patient
Protection and Affordable Care Act.
Be it enacted by the Senate and House of Representatives of the United States of America in
Congress assembled,
SECTION 1. TECHNICAL CORRECTIONS RELATING TO THE DEFINITIONS OF
INDIAN IN PPACA.
IN GENERAL.—Title I of the Patient Protection and Affordable Care Act is amended—
(1) in section 1311(c)(6)(D), by striking ‘‘(as defined in section 4 of the Indian Health
Care Improvement Act)’’ and inserting ‘‘(as defined in section 447.50(b)(1) of title 42 of
the Code of Federal Regulations, as in effect on July 1, 2010)’’; and
(2) in section 1402(d)(1), by striking ‘‘(as defined in section 4(d) of the Indian Self-
Determination and Education Assistance Act (25 U.S.C." "450b(d)))’’ and inserting ‘‘(as
defined in section 447.50(b)(1) of title 42 of the Code of Federal Regulations, as in effect
on July 1, 2010)’’.
(3) in section 1501(b), by striking “MEMBERS OF INDIAN TRIBES. —Any applicable
individual for any month during which the individual is a member of an Indian tribe (as
defined in section 45A(c)(6)) and inserting ‘‘INDIANS.—Any applicable individual who
is an Indian (as defined in section 447.50(b)(1) of title 42 of the Code of Federal
Regulations, as in effect on July 1, 2010).”
