(46) Council Regulation (EC) 2236/95 of 18 September 1995 26 laying down ge<strong>ne</strong>ral rules for the<br />

granting of Community financial aid in the field of trans-European <strong>ne</strong>tworks and Regulation<br />

(EC) No 680/2007 of the European Parliament and of the Council should accordingly be<br />

repealed.<br />

(47) The financial interests of the European Union should be protected through proportionate<br />

measures throughout the expenditure cycle, including the prevention, detection and<br />

investigation of irregularities, the recovery of funds lost, wrongly paid or incorrectly used<br />

and, where appropriate, penalties.<br />

(48) Some of the infrastructure projects of Union interest might <strong>ne</strong>ed to link with and pass through<br />

<strong>ne</strong>ighbourhood, pre-accession and other third countries. The Con<strong>ne</strong>cting Europe Facility<br />

should offer simplified means of linking and financing these infrastructures, in order to ensure<br />

coherence between internal and external instruments of the Union budget.<br />

(49) Since the objectives of the action to be taken, and in particular the coordinated, development<br />

and financing of the trans-European <strong>ne</strong>tworks, cannot be sufficiently achieved by the Member<br />

States and can therefore, by reason of the <strong>ne</strong>ed for coordination of these objectives, be better<br />

achieved at Union level, the Union may adopt measures in accordance with the principle of<br />

subsidiarity as set out in Article 5 of the Treaty on European Union. In accordance with the<br />

principle of proportionality, as also set out in that Article, this Regulation does not go beyond<br />

what is <strong>ne</strong>cessary in order to achieve those objectives,] 27<br />
