CHAPTER 24-A.<br />

REGULATION OF ORGANIZATIONS SOLICITING PUBLIC DONATIONS.<br />

NOTE: Four <strong>of</strong> the sections which comprise this chapter appeared in the<br />

compiled code as sections 8697 to 8700, inclusive, in the title on "Criminal Law".<br />

39 G. A., ch. 59, specifically changed the language in two <strong>of</strong> these sections and<br />

made necessary a change in the cross reference in the other two sections; it also<br />

added some new matter. The effect <strong>of</strong> the legislation <strong>of</strong> the 39th G. A. was to<br />

make the law on the subject <strong>of</strong> this chapter largely regulatory, leaving the criminal<br />

feature only incidental. For that reason the four sections <strong>of</strong> the compiled<br />

code and the new legislation are placed in this title as one chapter.<br />

SECTION 1261-al. Filing statement—contents.<br />

1 All organizations, institutions, or charitable associations which,<br />

2 through agents or representatives, solicit public donations in this state,<br />

3 shall be required to file with the secretary <strong>of</strong> state a statement setting<br />

4 forth the name and location <strong>of</strong> such organization, institution or chari-<br />

5 table association, the purposes for which such organization, institution<br />

6 or charitable association exists, and the name <strong>of</strong> its principal <strong>of</strong>ficers<br />

7 and soliciting agents, and references or recommendation from at least<br />

8 three reputable freeholders <strong>of</strong> the state.<br />

SEC. 1261-a2. License by secretary <strong>of</strong> state.<br />

1 If, in the judgment <strong>of</strong> the secretary <strong>of</strong> state, such statement shall<br />

2 be deemed sufficient evidence that the moneys thus collected are to be<br />

3 used in the interest <strong>of</strong> the purposes represented, the secretary <strong>of</strong> state<br />

4 shall be authorized to issue to said organization, institution or chari-<br />

5 table association, its agents and representatives, a state license, upon<br />

6 the payment <strong>of</strong> a fee <strong>of</strong> one dollar, authorizing said organization, insti-<br />

7 tution or charitable association to solicit public donations in any<br />

8 county, city or township in this state.<br />

SEC. 1261-a3. Duration <strong>of</strong> license—revocation.<br />

1 Said license shall expire annually on the thirty-first day <strong>of</strong><br />

2 December following the date <strong>of</strong> issue, or may be suspended or revoked<br />

3 at any time at the discretion <strong>of</strong> the secretary <strong>of</strong> state, when in his<br />

4 judgment the authority vested therein is abused or the transactions<br />

5 consummated thereunder are not in conformity with the intent and<br />

6 purpose <strong>of</strong> this chapter.<br />

SEC. 1261-a4. Soliciting by local organizations.<br />

1 Nothing in this chapter, however, shall be construed to prohibit<br />

2 any person or local organization, church, school or any recognized<br />

3 society or branch <strong>of</strong> any church or school from publicly soliciting<br />

4 funds or donations within the county or adjoining counties in which<br />

5 such person resides or such church, school, institution, organization<br />

6 or charitable association is located.<br />
