4 desirability <strong>of</strong> said land for park purposes and if the board reports<br />

5 favorably then said board and the executive council may purchase the<br />

6 same from the person or persons by whom the same was acquired, or<br />

7 said board and the executive council may institute condemnation pro-<br />

8 ceedings under the statutes provided for that purpose to acquire the<br />

9 land at a reasonable price. The state board <strong>of</strong> conservation shall act<br />

10 as trustee until said lands are paid for by the state. Payment for said<br />

11 lands shall be made out <strong>of</strong> the appropriation made by the legislature<br />

12 for the purchase and improvement <strong>of</strong> state parks.<br />

SEC. 1177-a2. Jurisdiction over meandered streams and lakes.<br />

The state board <strong>of</strong> conservation is hereby authorized to take control<br />

and management <strong>of</strong> all meandered streams and lakes belonging to<br />

the state for park purposes, the jurisdiction over which has not otherwise<br />

been conferred by law.<br />

SEC. 1182-al. Powers <strong>of</strong> counties to acquire parks.<br />

1 Authority is hereby granted to any county or counties to vote<br />

2 money for the purchase <strong>of</strong> land for park purposes for the benefit <strong>of</strong><br />

3 the community and state, and said lands when so acquired shall be<br />

4 turned over to the state and be placed under the management <strong>of</strong> the<br />

5 state board <strong>of</strong> conservation as a part <strong>of</strong> the state park system. Before<br />

6 any such purchase can be made, the question shall be submitted to the<br />

7 voters <strong>of</strong> the county or counties in the manner provided by law for<br />

8 the conducting <strong>of</strong> elections, and said submission to the voters shall be<br />

9 at a regular election and the amount <strong>of</strong> money required for the pur-<br />

10 chase <strong>of</strong> said lands shall be placed upon the ballot. If it is favorable<br />

11 to said proposition, then the board <strong>of</strong> supervisors may levy a sufficient<br />

12 tax to pay for the said lands.<br />

FENCES.<br />

SECTION 1187. Partition fences—owners to maintain.<br />

The respective owners <strong>of</strong> adjoining tracts <strong>of</strong> land shall upon written<br />

request <strong>of</strong> either owner, be compelled to erect and maintain partition<br />

fences, or contribute thereto, and keep the same in good repair<br />

throughout the year, and if said fence be hedge, the owner there<strong>of</strong><br />

shall trim or cut it back twice during each calendar year, the first time<br />

during the month <strong>of</strong> June and the last time during the month <strong>of</strong> September,<br />

to within five feet from the ground, unless such owners otherwise<br />

agree in writing to be filed with and recorded by the township<br />

clerk.<br />
