§§ 1110-1120-al. FISH AND GAME. Tit. V, Ch. 15.<br />

18 It shall be the duty <strong>of</strong> the fish and game warden, sheriffs, con-<br />

19 stables, and police <strong>of</strong>ficers <strong>of</strong> this state to seize and take possession<br />

20 <strong>of</strong> any fish, birds, or animals which have been caught, taken, or killed<br />

21 at a time, in a manner, or for a purpose, or had in possession or under<br />

22 control, or have been shipped, contrary to the provisions <strong>of</strong> this chap-<br />

23 ter. Such seizure may be made without a warrant.<br />

24 Any court having jurisdiction <strong>of</strong> the <strong>of</strong>fense, upon receiving pro<strong>of</strong><br />

25 <strong>of</strong> probable cause for believing in the concealment <strong>of</strong> any fish, birds,<br />

26 or animals, caught, taken, killed, had in possession, under control, or<br />

27 shipped contrary to any <strong>of</strong> the provisions <strong>of</strong> this chapter, shall issue<br />

28 a search warrant and cause a search to be made in any place therefor.<br />

29 Any fish, birds, or animals so found shall be sold for the purpose<br />

30 <strong>of</strong> paying the costs in the case, and the amount, if any, in excess <strong>of</strong><br />

31 the costs shall be turned into the school fund <strong>of</strong> the county in which<br />

32 the seizure is made.<br />

33 Any net, seine, trap, contrivance, material, and substance what-<br />

34 ever, while in use or had and maintained for the purpose <strong>of</strong> catching,<br />

35 taking, killing, trapping or deceiving any fish, birds, or animals con-<br />

36 trary to any <strong>of</strong> the provisions <strong>of</strong> this chapter is hereby declared to<br />

37 be, and is, a publie nuisance, and it shall be the duty <strong>of</strong> the fish and<br />

38 game warden, sheriffs, constables, and police <strong>of</strong>ficers <strong>of</strong> the state, with-<br />

39 out warrant or process, to take or seize any and all <strong>of</strong> the same, and<br />

40 abate and sell or destroy any and all <strong>of</strong> the same without warrant or<br />

41 process and no liability shall be incurred to the owner or any other<br />

42 person for such seizure and destruction, and said warden or his regu-<br />

43 larly constituted deputies or other peace <strong>of</strong>ficers as hereinbefore named<br />

44 shall be released from all liability to any person or persons whomso-<br />

45 ever for any act done or committed or property seized or destroyed<br />

46 under or by virtue <strong>of</strong> this section.<br />

SEC. 1110. Two lines—trolling from launches or steamboats.<br />

1 No person shall use more than two lines, with one hook upon each<br />

2 line, in still fishing, or otherwise, except that a trot line as above pro-<br />

3 vided, or in trolling a spoon hook composed <strong>of</strong> three hooks fastened<br />

4 together, may be used ; and no fish may be taken by trolling from any<br />

5 gasoline oil or electric launch or steamboat propelled by such power,<br />

6 from any <strong>of</strong> the lakes <strong>of</strong> the state. The foregoing clause relative to<br />

7 launches and steamboats shall not apply to or be effective upon the<br />

8 Mississippi or Missouri rivers.<br />

SEC. 1120-al. Black bass by hook and line only—exception.<br />

1 It shall be unlawful to catch or take or attempt to catch or take<br />

2 from the inland or boundary waters <strong>of</strong> the state <strong>of</strong> <strong>Iowa</strong>, for other<br />

3 than propagation purposes, any black bass except by hook and line,<br />

4 and, if caught or taken by any other means, the same shall be imme-<br />

5 diately returned to the waters from which taken, without unnecessary<br />

6 injury.<br />
