4 to comply with any <strong>of</strong> the provisions <strong>of</strong> this chapter, shall be guilty<br />

5 <strong>of</strong> a misdemeanor and upon conviction there<strong>of</strong>, be fined not exceeding<br />

6 one hundred dollars or imprisoned in the county jail not exceeding<br />

7 thirty days and after such conviction his license may be revoked by<br />

8 the inspector <strong>of</strong> hotels.<br />

SEC. 1094-al5. Injunction—duty <strong>of</strong> county attorney.<br />

1 It shall be the duty <strong>of</strong> the inspector upon ascertaining that any<br />

2 owner, manager, agent or person in charge is violating any <strong>of</strong> the<br />

S provisions <strong>of</strong> this chapter after the expiration <strong>of</strong> the time fixed in the<br />

4 notice provided in section ten hundred ninety-four-a eleven <strong>of</strong> this<br />

5 supplement to make complaint, and may file his petition in any court<br />

6 <strong>of</strong> competent jurisdiction or before any judge <strong>of</strong> such court in vaca-<br />

7 tion, upon which an injunction may issue with or without bond as may<br />

8 be ordered by the court or judge, restraining the further use <strong>of</strong> such<br />

9 restaurant until the provisions <strong>of</strong> this chapter are fully complied with ;<br />

10 but no injunction shall issue until after the defendant has had at<br />

11 least five days' notice <strong>of</strong> the application therefor, fixing a time for<br />

12 hearing thereon. It is hereby made the duty <strong>of</strong> the county attorney<br />

13 in either case to prepare the necessary papers and conduct all prose-<br />

14 cutions or litigation connected therewith.<br />

NOTE: The cross reference in the original act to section 11, is probably a<br />

mistake. Section 13 was evidently intended. The number "1094-all", however,<br />

is inserted above in accordance with the exact language <strong>of</strong> the original act.<br />

CHAPTER 15.<br />

FISH AND GAME.<br />

SECTION 1106. Warden—expenses—duties—seizure without warrant—sale.<br />

1 A state fish and game warden shall be appointed by the governor,<br />

2 and hold his <strong>of</strong>fice for three years from the first day <strong>of</strong> April <strong>of</strong> the<br />

3 year <strong>of</strong> his appointment.<br />

4 He shall have charge and management <strong>of</strong> the state fish hatch-<br />

5 eries, which shall be used in stocking the waters <strong>of</strong> the state with<br />

6 fish native to the country and to the extent <strong>of</strong> the means provided by<br />

7 the state.<br />

8 He shall impartially and equitably distribute all fry raised by or<br />

9 furnished to the state, or for it through other sources, in the streams<br />

10 and lakes <strong>of</strong> the state ; shall faithfully and impartially enforce obedi-<br />

11 ence <strong>of</strong> the provisions <strong>of</strong> this chapter, and shall make a biennial report<br />

12 to the governor <strong>of</strong> his doings, together with such information upon<br />

13 the subject <strong>of</strong> the culture <strong>of</strong> fish and the protection <strong>of</strong> game in the<br />

14 country as he may think proper, accompanied with an itemized state-<br />

15 ment monthly to the state board <strong>of</strong> audit under oath <strong>of</strong> all moneys<br />

16 expended and for what purpose, and <strong>of</strong> the number and varieties <strong>of</strong><br />

17 fish distributed, and in what waters.<br />
