§§ 1094-al0-1094-al4. RESTAURANTS AND EATING HOUSES. Tit. V, Ch. 13-A.<br />

SEC. 1094-alO. Sanitary conditions <strong>of</strong> utensils.<br />

1 In every restaurant the kitchen,- kitchen utensils, dining room,<br />

2 lunch counter, cellar, ice boxes, refrigerators, cooking utensils and all<br />

3 places where food is kept, stored, prepared or served, shall be kept<br />

4 and maintained in a sanitary condition, and the use <strong>of</strong> soiled or insani-<br />

5 tary tablecloths, napkins or other tableware is hereby prohibited.<br />

6 Where any <strong>of</strong> the above named equipment is found to be in an insani-<br />

7 tary condition it shall be condemned by the inspecting <strong>of</strong>ficer and<br />

8 further use <strong>of</strong> same shall forthwith be prohibited. There shall be no<br />

9 toilets, urinals or beds in any room or place where food is kept, stored,<br />

10 prepared or served. In toilet rooms and public wash rooms installed<br />

11 in restaurants the use <strong>of</strong> the roller towel, or common towel, and the<br />

12 common drinking cup is hereby prohibited.<br />

SEC. 1094-all. Report in re inspection.<br />

1 The deputy inspector shall make a full and complete report to<br />

2 the inspector <strong>of</strong> hotels <strong>of</strong> every restaurant inspected by him upon<br />

3 blanks furnished for that purpose, which report shall show the condi-<br />

4 tion <strong>of</strong> the restaurant inspected, as to its sanitary condition, the<br />

5 number and condition <strong>of</strong> its fire escapes, number <strong>of</strong> stories high, name<br />

6 <strong>of</strong> the proprietor, fee charged for license, and such other information<br />

7 as the inspector <strong>of</strong> hotels may determine will be for the betterment <strong>of</strong><br />

8 the public health.<br />

SEC. 1094-al2. Misfeasance <strong>of</strong> inspector—penalty.<br />

1 Any inspector or deputy who shall knowingly certify falsely<br />

2 regarding any restaurant inspected by him, or shall issue a license to<br />

3 any person owning, managing, or operating a restaurant when such<br />

4 person has not complied with the provisions <strong>of</strong> this chapter, shall be<br />

5 guilty <strong>of</strong> a misdemeanor, and upon conviction there<strong>of</strong> shall be punished<br />

6 by a fine not exceeding five hundred dollars or imprisonment in the<br />

7 county jail not exceeding six months or by both such fine and impris-<br />

8 onment.<br />

SEC. 1094-al3. Notice <strong>of</strong> violations to owner.<br />

1 It shall be the duty <strong>of</strong> the inspector upon ascertaining by inspec-<br />

2 tion or otherwise, that any restaurant is being carried on contrary to<br />

3 any <strong>of</strong> the provisions <strong>of</strong> this chapter, to notify the manager, pro-<br />

4 prietor or owner in writing in what respect it fails to comply with<br />

5 the law and requiring such person within a reasonable time, to be<br />

6 fixed by the inspector, to do or cause to be done the things necessary<br />

7 to make it comply with the law.<br />

SEC. 1094-al4. Interference with inspector — noncompliance —<br />

penalty.<br />

1 Any owner, manager, agent or person in charge <strong>of</strong> a restaurant<br />

2 who shall obstruct, hinder or interfere with an inspector or his deputy<br />

3 in the proper discharge <strong>of</strong> his duty, or who shall wilfully fail or neglect
