9 This chapter shall not apply to churches, lodges or like organiza-<br />

10 tions, which do not regularly as a business, engage in the serving <strong>of</strong><br />

11 food.<br />

SEC. 1094-a2. Application for license.<br />

1 On or before January first <strong>of</strong> each year every person, firm or cor-<br />

2 poration engaged in the business <strong>of</strong> conducting a restaurant shall make<br />

3 application to the inspector <strong>of</strong> hotels for a license to conduct such<br />

4 business.<br />

SEC. 1094-a3. Application blanks—issuance <strong>of</strong> license.<br />

1 The inspector <strong>of</strong> hotels upon request shall furnish to any person,<br />

2 firm or corporation desiring to conduct a restaurant an application<br />

3 blank to be filled out by such person, firm or corporation for a license<br />

4 therefor, and which shall require such applicant to state the full name<br />

5 and address <strong>of</strong> the owner <strong>of</strong> the building, the lessee, and manager <strong>of</strong><br />

6 such restaurant together with the full description <strong>of</strong> the building and<br />

7 property to be used or proposed to be used for such business, the loca-<br />

8 tion <strong>of</strong> the same, the name under which such business is to be con-<br />

9 ducted, and such other information as may be required therein by<br />

10 the inspector <strong>of</strong> hotels and such application shall be accompanied by<br />

11 the license fee provided in section ten hundred ninety-four-a five <strong>of</strong><br />

12 this supplement. Upon the approval <strong>of</strong> such application by the in-<br />

13 spector <strong>of</strong> hotels he shall issue a license to the applicant to conduct a<br />

14 restaurant in this state.<br />

SEC. 1094-a4. Duration <strong>of</strong> license—operation without license.<br />

1 Each license shall expire on the thirty-first day <strong>of</strong> December next<br />

2 following its issuance. No restaurant shall be maintained or con-<br />

3 ducted in this state without having secured a license therefor as pro-<br />

4 vided in this chapter, and no license shall be transferable, provided,<br />

5 however, that after the making <strong>of</strong> application for license as herein<br />

6 provided for, and pending the issuance <strong>of</strong> such license such restaurant<br />

7 shall be permitted to operate as such until the final refusal <strong>of</strong> such<br />

8 application by the inspector; provided, also, that no restaurant shall<br />

9 be denied relief in the courts in any action instituted by such res-<br />

10 taurant by reason <strong>of</strong> the fact that a license has not been issued to such<br />

11 restaurant.<br />

SEC. 1094-a5. License fee.<br />

1 The fee for a license to conduct a restaurant in this state shall<br />

2 be three dollars.<br />

SEC. 1094-a6. Disposition <strong>of</strong> fees.<br />

1 All fees received for license shall forthwith be paid over to the<br />

2 state treasurer and his receipt taken and kept on file in the <strong>of</strong>fice <strong>of</strong><br />

3 the inspector <strong>of</strong> hotels. Such fees shall be by the treasurer kept as a<br />

4 part <strong>of</strong> the hotel inspection fund and only paid out for bills or claims
