CHAPTER 12.<br />

FIRE ESCAPES.<br />

SECTION 1064. Class <strong>of</strong> escapes — mandatory and permissible<br />

kinds—stairways.<br />

1 Hotels, lodging houses, tenements, apartment buildings, schools,<br />

2 retail or department stores, seminaries, and college buildings, <strong>of</strong>fice<br />

3 buildings, hospitals, asylums, opera houses, theaters, assembly halls<br />

4 and factories required to be equipped by law shall be equipped with<br />

5 escapes <strong>of</strong> class "A" or class "B". All other buildings and structures<br />

6 required to be equipped with fire escapes shall be equipped with some<br />

7 one or more <strong>of</strong> said classes <strong>of</strong> fire escapes.<br />

8 Class "C" shall not be used on any building over three stories in<br />

9 height in which more than five persons are at any one time allowed<br />

10 upon any one <strong>of</strong> the floors above said third story nor where any <strong>of</strong><br />

11 the persons allowed upon any floor above the third story are females<br />

12 or minors ; provided, however, the commissioner <strong>of</strong> the bureau <strong>of</strong> labor<br />

13 statistics may under peculiar conditions and where the hazards are<br />

14 not great permit fire escapes <strong>of</strong> class "C" to be used on buildings <strong>of</strong><br />

15 more than three stories, but when ladder fire escapes are permitted<br />

16 on buildings more than three stories in height the ladders there<strong>of</strong> must<br />

17 <strong>of</strong>fset at the platforms and not be continuous from one story to the<br />

18 next.<br />

19 Said commissioner may under peculiar cpnditions, and where the<br />

20 hazard is not great, permit fire escapes <strong>of</strong> class "C" or other approved<br />

21 means <strong>of</strong> escape to be used on an ordinary dwelling <strong>of</strong> not more than<br />

22 three stories in height and temporarily used in part for lodging pur-<br />

23 poses, when not more than five persons none <strong>of</strong> whom are under six-<br />

24 teen years <strong>of</strong> age occupy the third floor.<br />

25 Where stairways not less than forty-four inches in clear width<br />

26 are provided they shall be taken as the equivalent <strong>of</strong> two or more<br />

27 single stairways in proportion to their width, provided the means <strong>of</strong><br />

28 escape and efficiency and safety <strong>of</strong> said escapes are not thereby dimin-<br />

29 ished.<br />

CHAPTER 13-A.<br />

RESTAURANTS AND EATING HOUSES.<br />

SECTION 1094-al. Restaurant defined.<br />

1 Every building or structure kept, used, advertised as or held out<br />

2 to the public to be à restaurant, cafe, cafeteria, dining hall, lunch<br />

3 counter, lunch wagon or place where food is served for pay, to the<br />

4 public, except those used not more than one day in any week by<br />

5 churches, fraternal societies and civic organizations, shall for the pur-<br />

6 poses <strong>of</strong> this chapter be defined to be a restaurant and wherever the<br />

7 word "restaurant" shall occur in this chapter it shall be construed to<br />

8 mean and cover every such place as is described in this section.
