9 witnesses. A party found guilty <strong>of</strong> contempt under the provisions <strong>of</strong><br />

10 this section shall for the first <strong>of</strong>fense be punished by a fine <strong>of</strong> not less<br />

11 than two hundred nor more than one thousand dollars, or by impris-<br />

12 onment in the county jail not less than three nor more than six<br />

13 months, or by both fine and imprisonment. A party who, having once<br />

14 been found guilty <strong>of</strong> contempt for violating the provisions <strong>of</strong> any such<br />

15 injunction, shall for each such subsequent violation be punished by a<br />

16 fine <strong>of</strong> not less than five hundred dollars or more than one thousand<br />

17 dollars or by imprisonment in the county jail for not less than six<br />

18 months nor more than one year.<br />

SEC. 998. Prima facie evidence.<br />

1 The certified copy furnished by the internal revenue collector <strong>of</strong><br />

2 the name <strong>of</strong> any person who has paid to the federal government the<br />

3 special tax imposed upon the business <strong>of</strong> selling intoxicating liquors<br />

4 shall be prima facie evidence that said person is engaged in the sale<br />

5 <strong>of</strong>, or keeping with intent to sell, intoxicating liquors in violation <strong>of</strong><br />

6 law, unless said person by way <strong>of</strong> defense shows that he is a registered<br />

7 pharmacist actually engaged in business as such and said certified<br />

8 copy shall be competent evidence in any court within this state.<br />

CHAPTER 10.<br />

STATE FIRE MARSHAL.<br />

SECTION 1039. Deputy.<br />

1 The state fire marshal is hereby empowered to appoint a deputy<br />

2 fire marshal to assist him in his work.<br />

SEC. 1049. Expenses.<br />

The said fire marshal, his deputies and assistants shall be entitled<br />

to their actual and necessary traveling, hotel and other expenses while<br />

away from the city <strong>of</strong> Des Moines on business <strong>of</strong> the <strong>of</strong>fice; and the<br />

said fire marshal may contract such other expenses as may be necessary<br />

in the performance <strong>of</strong> his <strong>of</strong>ficial duties.<br />

SEC. 1053. Annual appropriation for expenses and fees.<br />

There is hereby appropriated out <strong>of</strong> any money in the state treasury<br />

not otherwise appropriated the sum <strong>of</strong> six thousand five hundred<br />

dollars annually, or so much there<strong>of</strong> as may be necessary for the purpose<br />

<strong>of</strong> paying the expenses and fees authorized by this chapter. The<br />

said fire marshal shall keep on file in the <strong>of</strong>fice an itemized statement<br />

<strong>of</strong> all expenses incurred by his department, and shall approve all<br />

vouchers issued, and said vouchers shall be allowed and paid out <strong>of</strong><br />

the funds hereby appropriated in the same manner that other claims<br />

against the state are paid, upon approval <strong>of</strong> the state board <strong>of</strong> audit.<br />
