10 cigarette papers or wrappers, with intent to violate the law, or author-<br />

11 ize or permit the same to be done, such magistrate shall issue his<br />

12 warrant particularly describing the place to be searched and the per-<br />

13 son or persons to be apprehended or things to be seized directed to<br />

14 any peace <strong>of</strong>ficer in the county, for the purpose <strong>of</strong> searching such<br />

15 house, building or place and for the seizure <strong>of</strong> such cigarettes, cigar-<br />

16 ette papers or cigarette wrappers, or any paper made for the purpose<br />

17 <strong>of</strong> making cigarettes, and for the apprehension <strong>of</strong> the occupant or<br />

18 keeper there<strong>of</strong>.<br />

SEC. 913-al8. Seizure—destruction.<br />

The said cigarettes or cigarette papers and the keeper shall be<br />

brought before such magistrate to be dealt with as provided by law.<br />

All such cigarettes or cigarette papers, so seized, and unlawfully kept,<br />

shall be destroyed and an entry there<strong>of</strong> shall be made upon his docket.<br />

SEC. 913-al9. Prima facie evidence <strong>of</strong> intent to sell.<br />

1 The discovery <strong>of</strong> cigarettes or cigarette papers in any public place<br />

2 shall be prima facie evidence <strong>of</strong> the keeper's intent to unlawfully sell<br />

3 or give the same as prohibited in section fifty hundred six <strong>of</strong> the code.<br />

and has been retained because there is no corresponding number in the compiled<br />

code or in this supplement, since 39 G. A., ch. 203 repealed sections 5006 and 5007<br />

<strong>of</strong> the code <strong>of</strong> 1897, and sections 5007-c and 5007-d <strong>of</strong> the supplement to the code,<br />

1913, and enacted sixteen sections in lieu <strong>of</strong> the four repealed sections which<br />

appear as sections 913-al to 913-al6, inclusive, <strong>of</strong> this supplement.<br />

SEC. 913-a20. Tax assessed.<br />

1 The magistrate who shall try said cause and then issue an order<br />

2 condemning and destroying any cigarettes or cigarette papers as pro-<br />

3 vided in the second preceding section, shall certify a copy <strong>of</strong> the record<br />

4 <strong>of</strong> such proceedings to the treasurer <strong>of</strong> the county within ten days<br />

5 after the order to destroy such cigarettes or cigarette papers is issued<br />

6 and a tax assessment <strong>of</strong> three hundred dollars against the property<br />

7 in or upon which the cigarettes or cigarette papers or cigarette wrap-<br />

8 pers were unlawfully kept or sold, provided for in section fifty hundred<br />

9 six <strong>of</strong> the code, and collect the same as therein provided.<br />

SEC. 913-a21. Notice <strong>of</strong> assessment.<br />

1 Within thirty days after the receipt <strong>of</strong> the magistrate's certifi-<br />

2 cate, the county treasurer shall notify the keeper <strong>of</strong> such house, build-<br />

3 ing or place, and the owner there<strong>of</strong> <strong>of</strong> such assessment.<br />
