6 keep an accurate record <strong>of</strong> all stamps coming into and leaving his<br />

7 hands. The treasurer <strong>of</strong> state shall sell the stamps herein provided<br />

8 for only to dealers holding permits issued as provided in this chapter<br />

9 and the moneys received from the sale <strong>of</strong> said stamps shall be turned<br />

10 into the general fund <strong>of</strong> the state.<br />

11 The treasurer <strong>of</strong> the state shall redeem and make repayment, for<br />

12 any unused stamps on written request made by any such dealer and<br />

13 pay for same out <strong>of</strong> any funds derived from the provisions <strong>of</strong> this<br />

14 chapter.<br />

15 It shall be unlawful for a dealer to sell such stamps to another<br />

16 dealer or to any person whensoever, except as herein provided.<br />

SEC. 913-al5. Treasurer <strong>of</strong> state to enforce.<br />

1 The treasurer <strong>of</strong> state is hereby authorized to select and appoint<br />

2 an additional assistant to the treasurer <strong>of</strong> state, whose sole duties it<br />

3 shall be to administer and see that the provisions <strong>of</strong> this chapter are<br />

4 enforced, including the collection <strong>of</strong> all stamp taxes provided for<br />

6 herein. In the enforcement <strong>of</strong> this chapter he may call to his aid the<br />

6 attorney general, the special agents, any county attorney or any peace<br />

7 <strong>of</strong>ficer. The treasurer <strong>of</strong> state is further authorized to appoint such<br />

8 clerks and additional help as may be needed to carry out the provisions<br />

9 <strong>of</strong> this chapter. The compensation <strong>of</strong> all persons employed hereunder<br />

10 to be fixed by the executive council and to be paid from the revenues<br />

11 derived hereunder.<br />

SEC. 913-al6. Violations—penalty.<br />

1 Any person, firm or corporation violating any <strong>of</strong> the provisions<br />

2 <strong>of</strong> this chapter, or maintaining a place where such cigarettes or cigar-<br />

3 ette papers are sold or kept with intent to sell in violation <strong>of</strong> the pro-<br />

4 visions <strong>of</strong> this chapter, shall be deemed guilty <strong>of</strong> keeping and main-<br />

5 taining a nuisance, and the building or place so used for the sale or<br />

6 keeping for sale <strong>of</strong> cigarettes or cigarette papers, or wrappers, in<br />

7 violation <strong>of</strong> the provisions <strong>of</strong> this chapter shall be deemed to be a<br />

8 nuisance, and such person, firm or corporation may be enjoined and<br />

9 such building or place abated as a nuisance, and the procedure for the<br />

10 actions to enjoin and abate such nuisance, or for contempt in violating<br />

11 an order <strong>of</strong> injunction, shall be, so far as applicable, the same as those<br />

12 now provided by the laws <strong>of</strong> this state for enjoining and abating<br />

13 intoxicating liquor nuisances.<br />

4 nearly as may be, and the occupant, is unlawfully used as a place in<br />

5 which to receive, keep, store, sell or give away eigarettes, cigarette<br />

6 papers or cigarette wrappers^ or any paper made or prepared for the<br />

7 purpose <strong>of</strong> making cigarettes, or for the purpose <strong>of</strong> being filled with<br />

8 tobacco for smoking; or that the occupant is in any way concerned,<br />

9 engaged or employed in owning or keeping any such cigarettes or
