3 invested with the authority <strong>of</strong> a justice <strong>of</strong> the peace to issue subpoenas,<br />

4 requiring the attendance <strong>of</strong> witnesses before them to give their testi-<br />

5 mony by deposition or affidavit, in any matter in which such deposition<br />

6 or affidavit may be taken by the law <strong>of</strong> such other state, and they are<br />

7 also authorized to administer oaths in any matter in relation to which<br />

8 they are required or permitted by such law <strong>of</strong> the other states; and<br />

9 false swearing in such cases is hereby made subject to the penal laws<br />

10 <strong>of</strong> this state relating to perjury; but such commissioner shall cause to<br />

11 be filed in the <strong>of</strong>fice <strong>of</strong> the governor a certificate <strong>of</strong> the secretary <strong>of</strong><br />

12 the state or territory for which he claims to act, that he is properly<br />

13 appointed and qualified, as required by the laws <strong>of</strong> said state, and has<br />

14 in his possession a certificate that this section has been complied with.<br />

SEC. 693-a5. Governor to keep record.<br />

1 The governor shall keep in his <strong>of</strong>fice a complete record <strong>of</strong> all<br />

2 appointments made by him pursuant to the provisions <strong>of</strong> this chapter.<br />

CHAPTER 27.<br />

NOTARIES PUBLIC.<br />

SECTION 695. Conditions.<br />

1 Before any such commission is delivered to the person appointed,<br />

2 he shall :<br />

3 1. Procure a seal on which shall be engraved the words "Notarial<br />

4 Seal" and "<strong>Iowa</strong>", with his surname at length and at least the initials<br />

5 <strong>of</strong> his christian name.<br />

6 2. Execute a bond to the state <strong>of</strong> <strong>Iowa</strong> in the sum <strong>of</strong> five hundred<br />

7 dollars conditioned for the true and faithful execution <strong>of</strong> the duties<br />

8 <strong>of</strong> his <strong>of</strong>fice, which bond, when secured by personal surety, shall be<br />

9 approved by the clerk <strong>of</strong> the district court <strong>of</strong> the county <strong>of</strong> his resi-<br />

10 dence ; all other bonds shall be approved by the governor.<br />

11 3. Write on said bond, or a paper attached thereto, his signature,<br />

12 and place thereon a distinct impression <strong>of</strong> <strong>of</strong>ficial seal.<br />

13 4. File such bond with attached papers, if any, in the <strong>of</strong>fice <strong>of</strong> the<br />

14 governor.<br />

15 5. Remit to the governor the sum <strong>of</strong> five dollars for the three<br />

16 year period provided by law.<br />

17 When the governor is satisfied that the foregoing requirements<br />

18 have been fully complied with, he shall execute and deliver a commis-<br />

19 sion to the person appointed.<br />
