TITLE XXXI.
PARTICULAR ACTIONS.
CHAPTER 7.
FORCIBLE ENTRY OR DETENTION OF REAL PROPERTY.
SECTION 8091. Petition—venue.
1 The action must be by petition which must be sworn to and when
2 brought before a justice of the peace, and there is none present or
3 qualified to act in the township where the subject thereof is situated,
4 it may be brought in an adjoining township in the county. If there
5 be no such justice in an adjoining township in the county it may be
6 commenced before the justice in the same county nearest to the town-
7 ship in which the subject thereof is situated. In any such action a
8 change of place of trial may be had as in other cases. When brought
9 in municipal court or before the justice of the peace, a petition must
10 be on file at the time the defendant is required to appear by the notice.

SECURITIES AND INVESTMENTS OF TRUST FUNDS.
SECTION 8427. Bonds to secure performance of public contracts
in excess of one thousand dollars.
1 Whenever any public body, board, committee, officer or other
2 public representative now or hereafter empowered by law to enter into
3 a contract, for and on behalf of the public, for the purpose of con-
4 structing any public building, or for the purpose of making any public
5 improvement, or for the making or any additions thereto, or for the
6 finishing, furnishing, repairing or maintenance of any such buildings
7 or public work, such body, board, committee, officer or other public
8 representative, whenever the contract price is in excess of one thou-
9 sand dollars, shall require as a condition precedent to the making of
10 such contract that the person, firm or corporation to whom the con-
11 tract is awarded furnish and file a bond, as hereinafter provided, in
12 a sum of not less than seventy-five per cent of the contract price, the
13 amount of said bond and the nature of the surety to be determined
14 by those representing the public.
15 In the event the surety upon said bond is other than a surety
16 company authorized to do business in Iowa, such surety must be a
