COURTS OP RECORD OF ORIGINAL JURISDICTION.<br />

CHAPTER 1.<br />

MUNICIPAL COURT.<br />

SECTION 6840. Municipal court—limits <strong>of</strong> city denned.<br />

1 Any city, whether organized under commission form <strong>of</strong> govern-<br />

2 ment or the general law for the incorporation <strong>of</strong> cities or towns, now<br />

3 or hereafter having a population <strong>of</strong> five thousand or more, as shown<br />

4 by the last preceding state or United <strong>State</strong>s census, may establish a<br />

5 municipal court under the provisions <strong>of</strong> this chapter by proceeding as<br />

6 hereinafter provided, and for the purpose <strong>of</strong> this chapter, the terri-<br />

7 torial limits <strong>of</strong> any such city shall be held to extend to the limits and<br />

8 include therein all civil townships in which said city or any part<br />

9 there<strong>of</strong> is located. Provided, that if such territorial limits include the<br />

10 territorial limits <strong>of</strong> an incorporated town, the mayor's court <strong>of</strong> such<br />

11 town shall have exclusive jurisdiction <strong>of</strong> prosecutions for the violation<br />

12 <strong>of</strong> the ordinances <strong>of</strong> such town.<br />

SEC. 6844. Inferior courts abolished—exceptions—dockets and<br />

records delivered to clerk.<br />

1 After the adoption <strong>of</strong> the proposition to establish a municipal<br />

2 court under the provisions <strong>of</strong> this chapter, and upon the election or<br />

3 appointment and qualification <strong>of</strong> the <strong>of</strong>ficers herein provided for, the<br />

4 police court, mayor's court, justice <strong>of</strong> the peace court and the superior<br />

5 court in and for the territory within the municipal court district, shall<br />

6 be abolished and the <strong>of</strong>fices <strong>of</strong> police judge, clerk <strong>of</strong> police court, jus-<br />

7 tices <strong>of</strong> the peace, constables, superior judge and clerk <strong>of</strong> superior<br />

8 court shall likewise be abolished ; and when said <strong>of</strong>fices shall be abol-<br />

9 ished the dockets <strong>of</strong> such courts and all records and papers in their<br />

10 possession pertaining to any proceedings had before them shall be<br />

11 forthwith delivered to the clerk <strong>of</strong> the municipal court, who shall pre-<br />

12 serve same in his <strong>of</strong>fice and who shall have full power and authority<br />

13 to certify and transcript such proceedings, as appear in the said dock-<br />

14 ets and records and papers <strong>of</strong> the said courts, and all subsequent pro-<br />

15 ceedings in any cause <strong>of</strong> action then pending in any <strong>of</strong> the said courts<br />

16 so abolished, shall be carried out in the said municipal court in the<br />

17 manner herein provided for, the same as if the said cause had orig-<br />

18 inated in said municipal court.<br />

19 Provided, that if an incorporated town is situated within the<br />

20 territorial limits <strong>of</strong> a municipal court district, the mayor's court in
