24 shall be that <strong>of</strong> a depository for hire ; and in no event shall liability ex-<br />

25 ceed two hundred fifty dollars for each trunk and its contents, one hun-<br />

26 dred fifty dollars for each valise and its contents, fifty dollars for each<br />

27 box, bundle or package and its contents and not exceeding one hundred<br />

28 dollars for any and all other miscellaneous effects <strong>of</strong> each guest ; and<br />

29 provided further, that, in case baggage or other personal property <strong>of</strong> a<br />

30 guest has remained in any hotel, inn, eating house or steamboat forty-<br />

31 eight hours after the guest has paid his bill and registered <strong>of</strong>f and the<br />

32 relation <strong>of</strong> keeper and guest has ceased the keeper may hold such bag-<br />

33 gage or property at the risk <strong>of</strong> the owner, and in case baggage or other<br />

34 property has been forwarded to any hotel, inn, eating house or steam-<br />

35 boat and the owner <strong>of</strong> such baggage or property does not within f orty-<br />

36 eight hours become a guest, the keeper <strong>of</strong> such hotel, inn, eating house<br />

37 or steamboat after such time may hold such baggage or property at<br />

38 the risk <strong>of</strong> the owner.<br />

39 Hotel, inn, rooming house or eating house keepers shall have a<br />

40 lien upon, and may take and retain possession <strong>of</strong>, all baggage and<br />

41 other property belonging to or under the control <strong>of</strong> their guests or<br />

42 patrons, which may be in such hotel, inn, rooming house or eating<br />

43 house, for the value <strong>of</strong> their accommodations and keep, and for all<br />

44 money paid for or advanced to, and for such extras and other things<br />

45 as shall be furnished such guest or patron, and such property so<br />

46 retained shall not be exempt from attachment or execution to the<br />

47 amount <strong>of</strong> the reasonable charges <strong>of</strong> such hotel, inn, rooming house<br />

48 or eating house keeper, against such guest or patron, and the costs <strong>of</strong><br />

49 enforcing the lien thereon. The innkeeper or hotel keeper shall retain<br />

50 such baggage and other property upon which he has a lien for a period<br />

51 <strong>of</strong> ninety days, at the expiration <strong>of</strong> which time, if such lien is not<br />

52 satisfied, he may sell such baggage and other property at public auc-<br />

53 tion after giving ten days' notice <strong>of</strong> the time and place <strong>of</strong> sale in a<br />

54 newspaper <strong>of</strong> general circulation in the county where the inn or hotel<br />

55 is situated, and also by mailing a copy <strong>of</strong> such notice addressed to said<br />

56 guest or boarder at the place <strong>of</strong> residence registered by him in the<br />

57 register <strong>of</strong> such inn or hotel. After satisfying the lien and any costs<br />

58 that may accrue, any residue remaining shall, on demand within six<br />

59 months, be paid to such guest or boarder, and if not so demanded<br />

60 within six months from date <strong>of</strong> such sale, such residue shall be depos-<br />

61 ited by such innkeeper or hotel keeper with the treasurer <strong>of</strong> the county<br />

62 in which the inn or hotel is situated, together with a statement <strong>of</strong> the<br />

63 innkeeper's claim and the costs <strong>of</strong> enforcing same, a copy <strong>of</strong> the pub-<br />

64 lished notice, and the amounts received for the goods sold at said sale ;<br />

65 said residue shall by said county treasurer be credited to the general<br />

66 revenue fund <strong>of</strong> said county, subject to a right <strong>of</strong> said guest or board-<br />

67 er, or his representative, to reclaim at any time within three years <strong>of</strong><br />

68 the date <strong>of</strong> deposit with the said treasurer.<br />
